G. Non-Discrimination. No member or official of the Police <br />Department shall be removed, disciplined, harassed or discriminated <br />against because he has filed or pursued~a grievance under this ordinance, <br />except under the following conditions. The Negotiating Committee shall <br />have the right to investigate and decide if the grievance brought before <br />them is a 8rievable item under the ordinance. If an employee is <br />repeatedly filing grievances and no basis are found for the grievances, <br />and the facts show these actions are disrupting or impairing the operation <br />of the Police Department or City, disciplinary action may be taken against <br />the employee. <br />ARTICLE XVI <br />LEGALITY <br />1. It is the intent of the City and the F.O.P. that this <br />Agreement comply in every respect with applicable legal statutes and <br />charter requirements. If it is determined that any provisions of this <br />Agreement is in conflict with any court of competent 3urisdiction, that <br />provision shall be null and void and shall not affect the validity of the <br />remaining paragraphs of this Agreement. <br />2. Any past understanding, ordinance or resolution which <br />has been in effect shall remain in effect until such time that it is <br />modified by a subsequent agreement. Such modification shall be completed <br />by the procedures set up in this Agreement for negotiations. <br />-19- <br />
