<br />.?, <br />of a maximum set-back, a minimum depth of the rear yard along the southerly <br />and westerly boundaries of the Property of fifty (50) feet as required by <br />Section 1135.06, parking as required by Section 1161.05(C), and otherwise <br />canstructed in accardance with the provisions of Title Seven of the <br />Ordinances of the City of North Olmsted pertaining to Multiple Residence <br />Districts, is consistent with the public health, safety and welfare of the <br />community of the City of North Olmsted. <br />4. Parcel C consists of 4.56 acres and its use for the cansruction of <br />and occupancy as either a full service hotel ar for office pu,poses as <br />prescribed with the limitations for office use in garagraph 2 of these <br />Stipulations and for hotel use in paragraph 5 af these Stipulations, is <br />consistent with the public health, safety and welfare of the community of <br />the City of Horth Olmsted. <br />5. Parcel D cansists of 6.79 acres and its use for the construction of <br />and occupancy as a full service hotel of eight (8) stories with a maximum <br />height of one hundred sxx (106) feet, a trtinimum lot aiea of five hundred <br />(500) square feet per lodging unit, and otherwise constructed and occupied <br />in accordance with Chapter 1139.10 of the 0•rdinances af the City of North <br />Olmsted, or for office purposes as prescribed with thp limitations for <br />oftice use in paragraph 2 of these 5tiipulations, is consistent with the <br />public health, safety and welfare of the carn??nunity of the City of North <br />Olmsted. <br />6. The parties agree that the most c3esir.able utilization af Parcel D <br />is as a full service hotel; and Plaintiffs agree that they will undertake <br />2
