Aisciplinary <br />action may be apgealed by the Union through the Grievance <br />Procedurg r..nmme»cing at Step 2 of the Grievance Procedure. An <br />employee who desires to protest the disciplinary action must make <br />an election within ten (10) calendar days folXowing receipt or <br />writtQn notioe as to whethQr ha wishPr, to pur.sue the grievance <br />prooedure. <br />(a) Whe» an employee is given a disciplinary action <br />inciuding a reprimand, the employee will reaeive a copy of <br />the discipZinary notiee placed in thP pQrsonnel file <br />maintained by the appxopriate Director or his designee. <br />(b) In imposing disaiplinn on a current charge, the City <br />Will not bage prvgxessive discipline on prior disciplinary <br />action which is more than two (2) years old, except for <br />prior di3oiplinary aQtion invalving cases of vialence or <br />theft. <br />(0) The offiaial personnel files will be laCated ixi the <br />offiae of the department Dixector or his designee. No <br />notice will be required to inspect the file by the Union <br />officer or employee, execspt that the Unioyn is limitcad to thQ <br />Iast fifteen (15) minutes of the work shift. The emplayee <br />may inspect his file during his non-working hours, but in <br />any evant should the depaxtment diroat4r ar hir, secretary <br />not be available tor a file inspectivn visit his inability <br />to inspect the file at the time shall not be the basis of a <br />yrievance. <br />(d) The City shall insure that aIl disciplinary dacuments <br />p].aced in ari empioyee's official personnel file shall be <br />first initialed and dated by the employee concerned. The <br />initialing of arty materials to be placed into any employea's <br />officla2 personnel recvra does not infc:r as to the contesstts <br />of the material, but does acknowledge that he has seen it. <br />SBCt].on 3.
