The Union shall notify the City of its intent <br />?. to appeai the qrievance to arbitratian in writing. Promptly <br />thereafter representatives of the City and the Union shall <br />meet for the pux'pose ot attexapti.ng to se].ect an arbitrator <br />by agreement. Yf they aannot so agree, the UnYOn shall send <br />written notice ot its intent ta arbitrate the grievance ta <br />the American Arbitration Association. If the Unian doe5 nat <br />send this notfce to the Amexican Arbitration Association <br />within six (6) months of notifying the City of its intsnt to <br />arbitrate a grievance, then the grievance shall be <br />aonsi.c3Qrpd witridrawn_ The American Arbitration Association <br />shall submit a panel of seven (7) arbitrators to each party <br />and the arbitrator shall thPn bp chosen Yn accnrdance with <br />the Association's then agplicable rules. The fees and <br />Qy_perises of nteeting room and stenngraphic rner.vice shall be <br />borne equa2ly by the parties. <br />Section 2. In the event a grievance goes to arbitration, <br />the arbitrator shall have jurisdiction only over disputes ariszng <br />out of grievances and the arbitrator shall have na authority to <br />add ta, subtract from, or modify ia-ar.y way the provisians of this <br />Agreement. The arbi.trator will be conducted under the voluntary <br />labor arbitration rules of the American Arbitrata.on Associata.an. <br />5ection 3. A11 awards of the arbitrator and all pre- <br />arbitration qrievance settlements reaahed by the Unian and the <br />City shall be final, binding, and conclusive on the City, t,he <br />Union, and the empZoyees. A grievance may be withdrawn without <br />prpjudica by the Unian at any time during Steps 1, 2, 3 or 4 of <br />the grievance procedure. A31 monies agree.d to be due in a pre- <br />arbitration settlement or following an arbitrativn award shall be <br />paid ta the emplovee on the PaYdaY for th.e pay period fallowing <br />(J the date of the agreement as to the exact amount owed. Such suia <br />shall be issued in a separate pay'roll check. <br />- 9 --
