AO"04 <br />fxACBiT 8 <br />Amended Version <br />CHAPTER 1118 <br />Conditional Use Permit <br />1118.01 Intent. 1118.04 Special conditions and <br />1118.02 Procedure. standards. <br />1118.03 General criteria and standards. 1118.05 Expiration. <br />1118.06 Revocation. <br />1118.01 INTENT. <br />Certain uses more intensely affect the surrounding area in which they are located than <br />permitted uses in the same zoning district. If properly controlled and regulated, these uses can <br />be compatible within the zoning district. To provide this necessary control such uses shall be <br />designated as conditional uses and allowable only upon review and granting of a conditional <br />use permit by City Council. Because of the uniqueness or special nature of a conditional use <br />with respect to location, design, size, and method of operation, each such use that comes <br />under review shall be considered individually. <br />1118.02 PROCEDURE. <br />(a) Application. Any owner of property in the City may submit an application to the <br />Building Official requesting a conditional use permit. The applicant shall follow the <br />submission procedures set forth in Chapter 1126 Commercial and Other Building <br />Permits. Any completed application received for such a permit shall be submitted by the <br />Building Official to the Planning and Design Commission. <br />(b) Hearing. The Commission shall hold a hearing on such application within thirty days <br />from the date of receiving such application. Notice of the hearing shall be provided by <br />the Clerk of Commissions as required in the Administrative Code Chapter 149. <br />(c) Approval. The Planning and Design Commission, upon making a finding, shall forward <br />the application and a report of its findings to Council for its confirmation. In approving <br />or disapproving an application, Council may take such additional testimony or evidence <br />as may be of assistance to its determination. <br />1118.03 GENERAL CRITERIA AND STANDARDS. <br />Conditional uses are listed within each zoning district. In addition to the development <br />regulations of the zoning district and any special conditions listed in this chapter, all applications <br />for a conditional use permit shall demonstrate that the following general criteria and standards <br />are met: <br />(a) The use is physically and operationally compatible with the surrounding neighborhood <br />and surrounding existing uses. <br />(1) The proposed use will not involve uses, activities, processes, materials, equipment <br />and conditions of operations that will be detrimental to any persons, property, or
