' 07=Dec-1994 D R A F T T H R E E <br />concerning wage 'rates, fringe benefits, pensions or other retirement benefits, <br />and working conditions. <br />16.2 The City may negotiate and enter into a collective bargaining agreement <br />with its employees in accordance with state law. The City shall not enter <br />collective bargaining agreements with respect to inherent management rights, <br />which include but are not limited to such areas of discretion or policy as the <br />functions of the employer, standards of services or its overall budget. The <br />City, however, may bargain collectively with regard to policy matters directly <br />affecting wages, hours and terms and conditions of employment, as well as the <br />impact thereon, upon request by employee representatives. <br />16.3 The Authority shall not be responsible for the reimbursement of costs <br />attributable directly or indirectly to any wage rates, fringe benefit, pensions <br />or other retirement benefits or working conditions, the level of which .would <br />exceed the rates, benefits and working conditions, respectively, then available <br />to the Authority's transit personnel. If the City is ordered by the State <br />Employee Relations Board or any other federal or state agency or court of <br />competent jurisdiction to grant its transit employees any wage rates, fringe <br />benefits., pensions, or other retirement benefits or working conditions the <br />level of which exceeds the level of those available to the Authority's transit <br />personnel, the additional direct or indirect costs of the excess wage rates, <br />fringe benefits, pensions or working conditions exceeding those available to <br />the Authority's personnel shall not be reimbursed by the Authority. <br />16.4 The City agrees to indemnify, defend. and hold the Authority harmless from <br />any obligation of the Authority to employees of the City'.s Public Transporta- <br />tion Department (North Olmsted Municipal Bus Line) for wage rates, fringe <br />-19- <br />
