07-Dec-1994 <br />D R A F T T H R E E <br />benefits, pensions, or working conditions which exceed those available to <br />Authority personnel. <br />16.5 The City will utilize drivers for the contracted services who are <br />properly qualified and lawfully licensed to operate vehicles for public transit <br />purposes in the State of Ohio. Drivers shall display proper courtesy towards <br />passengers and maintain a neat and clean appearance. The City shall utilize <br />drivers for this service who meet the physical qualifications established by <br />the U.S. Department of Transportation guidelines as applicable to transit bus <br />drivers. The City transit personnel shall, if directed to do so, participate <br />in operation or maintenance training programs established or utilized by the <br />Authority during the term of this Agreement. <br />16.6 The Authority shall make available to the City copies of all labor <br />contracts within ten (10) days of the signing thereof. <br />17. DRUG AND ALCOHOL TESTING PROGRAHS/AND POLICY <br />17.1 The City agrees that it shall adopt implement and maintain a Drug and <br />Alcohol Testing Policy applicable to City transit personnel in accordance with <br />the Omnibus Transportation Employee Testing Act of 1991 and applicable rules <br />and regulations issued by the Federal Transit Administration. <br />17.2 The Drug and Alcohol Testing Policy adopted by the City shall be <br />substantially similar to the Drug and Alcohol Testing Policy adopted by the <br />Authority and any .subsequent revision thereto. A copy of the Authority's Drug <br />and Alcohol Testing Program in effect as of the date of the execution of this <br />Agreement is attached as Schedule 6. A copy of the City's Drug and Alcohol <br />Testing Policy in effect as of the date of the execution of this Agreement is <br />attached as Schedule 6A. <br />-20- <br />
