' 07=Dec-1994 <br />18. NON-DISCRIMINATION <br />D R A F T T H R E E <br />18.1 Equal Opportunity. The Parties hereto agree that there shall be no <br />discrimination against any employee or applicant for employment because of <br />race, color, religion, sex or national origin. It is further agreed that the <br />City shall maintain an affirmative action plan to insure that applicants are <br />employed and that employees are treated during their employment without regard <br />to their race, color, religion, sex or national origin. Such action shall <br />include, but not be limited to, recruitment or recruitment. advertising, <br />selection for training, including apprenticeship, employment, upgrading, <br />demotion, transfer., layoff, termination, rates of pay or other forms of <br />compensation, and other terms and conditions of employment; a copy of the <br />City's Affirmative Action Plan is attached as Schedule 7. <br />18.2. This Agreement is subject to the Urban Mass Transportation Act of 1964, <br />as amended (49 U.S.C. 1601 et. seq.) and all rules, and regulations issued <br />pursuant thereto regarding non-discrimination in federally assisted programs of <br />the United States Department of Transportation. The City shall provide, its <br />current Affirmative Action Plan and any subsequent changes thereto. <br />18.3 The City will not discriminate on the basis of race, color, religion, <br />sex, or national origin in the selection and retention of contractees <br />including, but not limited to, procurements of materials and leases of <br />equipment purchased by the City to provide contracted services. <br />18.4 In all solicitations, either by competitive bidding or negotiations, made <br />by either party to this Agreement for work to be performed under a contract or <br />subcontract including, but not limited to, procurements of materials, services <br />or equipment, each potential contractee, subcontractee, or supplier shall be <br />-21- <br />
