' 07=Dec-1994 <br />D R A F T T H R E E <br />notified by said party of its obligations under this Agreement and the rules <br />and/or regulations relative to non-discrimination on the basis of race, color, <br />religion, sex or national origin. The City shall provide, on an annual basis, <br />its current Disadvantaged Business Enterprise Program applicable to <br />procurements made by the City on behalf of its public transportation <br />department. <br />18.5 The Parties further agree that no person in the United States shall, on <br />the grounds of race, color, religion, sex or national origin, be excluded from <br />participating in, be denied the benefits of, or be subject to discrimination <br />under any program or activity receiving federal financial assistance, as said <br />assistance relates to this Agreement. <br />18.6 The City shall not discriminate nor allow any of its officers, employees, <br />or agents to discriminate against any passenger or patron because of race, <br />color, sex, age, or national origin or ancestry. <br />18.7 The City shall notify Authority of any discrimination complaints filed <br />before any state or federal regulatory agency or court of competent <br />jurisdiction, arising out of its performance under this contract. <br />18.8 The City shall, at its sole cost and expense, conform to any final orders <br />issued by any state or federal agency or any court with jurisdiction to correct <br />City's discrimination in employment and/or ridership and shall fully save <br />harmless and indemnify Authority for any additional costs incurred by the City <br />in this regard subject to the indemnification provision contained herein. <br />18.9 The City will keep records and documents of five (5) years following <br />performance of this contract to indicate compliance with the non-discrimination <br />requirements of this contract. Such records and documents, or copies thereof, <br />-22- <br />
