case of an employee whose anniversary date falls ia~ the last <br />four (4) months of the calendar year, the employee may be allowed <br />to take vacation leave before the anniversary date by mutual <br />agreement between the employee and the City. <br />51. An employee shall become eligible for a vacation only <br />if he is actively employed in nine (9) of the tweIL~re (12) <br />months preceding his anniversary date. Paid sick leave shall <br />be considered active employment. <br />52. Tf an employee is terminated (voluntarily or involuntarily) <br />prior to taking his vacation, he shall receive the. pro-rated portion <br />,,, of any fully earned but unused vacation at the tiIIe of separation. <br />In case of death of an employee, the unused vacation leave shall be <br />paid to the estate. <br />53. (a) If a day recognized as a holiday b~ the terms of <br />this Memorandum falls within an employee's vacati®n leave, the <br />employee shall have the option of receiving an addii.tional day of <br />time off or an additional day's pay in recognitiam of the holiday. <br />(b) An employee may have the option of rising a <br />personal day as a day of extended vacation. <br />-30- <br />
