<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 79-139 <br />PAGE 10. <br />ditches to be fenced with a fence approved by <br />the City Engineer, and providing that a minimum <br />right-of-way of fifty (50) feet is provided for <br />service to said ditch.,Ditch banks shall be on <br />a minimum two (2) horizontal to one (1) vertical <br />slope and deeded. No relocated ditch bank shall <br />be closer than ten (10) feet to adjoining property. <br />(3) Water mains and appurtenances sha11 be <br />constructed in accordance with the specifications <br />of the City of Cleveland Water Department. <br />(C) Electrical Reauirements. <br />(1) The preliminaxy plat or sketch plan with <br />respect to any new subdivision shall be submitted <br />to all utility companies serving the subdivision, <br />as well as the Building Commissioner and City <br />Engineer, of the City of North Olmsted. <br />(2) Utility easements ten (10) feet in width for <br />communication and electric power and street light- <br />ing distribution lines and facilities shall be <br />provided on all front lot lines and along certain <br />side or rear lot lines where necessary. <br />(3) Prior to granting final approval, the subdivider <br />shall have installed or shall have furnished adec{uate <br />bond for the ultimate installation in accordance <br />with the rec{uirements of this Ordinance (No. 64-95) <br />"Platting Ordinance), and Ordinance No, 72-192 <br />(Codified Ordinance No. 1357) "National Electrical <br />(bde 1971 Edition" and all subsequent amendments <br />thereto pertaining to the following: <br />(a) Underground communication cables. <br />(b) Underground distribution cables for <br />power and street lighting from a common <br />distribution system, and the eauipment <br />and housing necessary in the operation <br />of the distribution system. <br />(c) Adequate provisions for street light <br />lamps and standards in accordance with the <br />design approved by Council. <br />The subdivider shall bear the increase in <br />costs, if any, over the normal mode of <br />construction of communication or electrical <br />lines and facilities, as determined by the <br />telephone or electric company involved in <br />accordance with the rules and regulations <br />of the telephone or electric company involved. <br />(4) The Building Commission (or Council or Planning <br />Commission) may authorize a variance from these <br />regulations when undo hardship may result from <br />strict compliance. In granting any variance, <br />the Building Commissioner (or Council or Planning <br />Commission) shall prescribe only conditions that he <br />(it) deems necessary or desirable for the public <br />interest and finds that there are special circum- <br />stances or conditions affecting said property such <br />that the strict application of the provisions of <br />this Ordinance would deprive the applicant of the <br />reasonable use of his land.
