such discipline shall immediately be removed from the Grievance <br />44 Procedure and the employee's appeal shall be determined <br />? exclusively by the Civil Service Conunission. An employee who <br />? desires to protest the disciplinary action must make an election <br />? within ten (10) calendar days following receipt of the written <br />? <br />notice as to whether he wishes to pursue the Grievance Procedure <br />,o or appeal to the Civil Service Commission. Recourse to either <br />,am procedure will be final and binding and shall exclude recourse <br />0" to the alternate procedure. <br />(a) When an employee is given a disciplinary action, <br />including a reprimand, the employee will receive a copy of the <br />disciplinary notice placed in the personnel file maintained at <br />City Hall. <br />*0 (b) In imposing discipline on a current charge, the <br />'m City will not base progressive discipline on prior disciplinary <br />vr <br />action which is more than two (2) years old in the case of <br />absenteeism or abuse of sick leave, or four (4) years old in all <br />other cases except prior disciplinary action involving violence <br />or theft. <br />A"' (c) Upon twenty-four (24) hour advance written notice <br />ow <br />to the Service Director, a Union representative may inspect the <br />official personnel file of any employee who gives such author- <br />ization to the Union expressly (forms to be provided by the <br />City).
