<br />{ <br />wFx <br /> <br />5, The Employee under interrogation and the investigator shall not <br />be subjected to abusive or threatening language. No promise of <br />reward shall be made. The Employee shall not be subjected to <br />visits by the press or news media without his express consent <br />nor shall his home address or photograph be given to the press <br />or news media without his express consent. When criminal charges <br />have been filed and it is necessary to assist in the apprehension <br />of the suspect, or to warn the public of any dangers a photograph <br />may be released to the news media or the press. <br />b. Upon request by the Employee or investigator any statement given <br />by the Employee shall be recorded in writing or by mechanical means. <br />The Law Director for the City, the appropriate Prosecutor's office <br />or the Civil Service Commission shall make any legal determination <br />regards furnishing a copy of the Employee's statement or permitting <br />the Employee to have access to the tape if any further proceedings <br />are contemplated. <br />~, If the Employee about to be interrogated is under arrest, or is a <br />suspect in a criminal investigation and the answers which the <br />Employee is asked to make to interrogators, and information derived <br />from such answers, will be used in a criminal trial, the Employee <br />shall be completely informed of all his Constitutional Rights prior <br />to the commencement of any interrogation. <br />g, The Employee shall be notified of the action and the reason or <br />reasons therefore prior to the effective date of such action. <br />F, In the event an Employee is arrested or indicted by a Grand Jury, <br />no photo will be released to any news media without the express <br />written consent of the Negotiating Committee by any Employee of <br />the North Olmsted Police Department except to assist in the <br />apprehension of the suspect, or to warn the public of any dangers. <br />1. The North Olmsted Police Department shall maintain one (1) confidential, <br />complete, official personnel file for each Employee. No anonymous <br />material shall be placed in the official personnel file,~and an _ <br />Employee shall have .the right to receive a copy of all material <br />placed therein .upon request. ,.,, <br />2. In addition, there may be one (1) official pre-employment file <br />which also shall be confidential and shall contain letters of <br />reference and recommendations and/or material related thereto <br />secured from sources outside the department. The Employee shall <br />have no right of access to the official confidential pre-employment <br />file. <br />3, Any Employee shall have the right to make such additions or responses <br />to the material contained in his office personnel file as he shall <br />deem necessary, but he shall have no right to remove material from <br />the file. <br /> <br /> <br />
