CITY OF NORTH OLMSTED <br />ORDINANCE NO . 7 5 - ~,~d <br />Page 3. <br />"ARTICLE V <br />SECTION 2: Director of Law <br />The Director of Law shall be the head of the Law Department <br />of the City and commencing with the regular municipal elec- <br />tion in the year 1977, and every fourth (4th) year thereafter, <br />he shall be elected for a term of four (4) years. His term <br />shall begin and he shall assume office on the first day of <br />January next following such election. The Director of Law <br />shall be empowered to designate such assistants as shall <br />be authorized by and approved by Council. No person shall <br />be eligible to be the Director of Law unless he is authorized. <br />to practice as an attorney in Ohio and has been engaged in <br />the active practice of law in Ohio continuously for a period <br />of five years next preceding his election, has been a quali- <br />fied elector and a resident of the City for at least two <br />(2) years immediately prior to the date of his election, and <br />shall continue to be a qualified elector and resident of <br />the City during his term of office. <br />In the event the office of Director of Law shall become <br />vacant for any reason, the Mayor shall appoint a successor, <br />subject to confirmation by a majority of the members of <br />Council, to serve for the unexpired term or until the elec- <br />tion of a successor for the unexpired term at the next regu- <br />lar municipal election provided that, (a) such election shall <br />occur more than two (2) years prior to the expiration of the <br />unexpired term, and (b) the vacancy shall have occurred more <br />than one hundred twenty (120) days prior to such election. <br />Upon concurrence of two-thirds of the members of Council, <br />the Council may, after public hearing, remove the Director <br />of Law from office for his disqualification while in office, <br />for his conviction while in office of a crime involving <br />moral turpitude, or for a violation of his oath of office. <br />Prior to such removal action, the Director of Law shall be <br />notified in writing of the charge or charges against him <br />at least ten (10) days in advance of any hearing upon such <br />charge or charges, and he and his counsel shall be given <br />an opportunity to be heard, present evidence, and examine <br />any witness appearing in support of such charge or charges. <br />The Director of Law shall act as legal counsel and serve <br />in such capacity the Mayor, Council, administrative officers, <br />departmexYts, and the commissions and boards of the City. <br />As legal counsel and. attorney, he shall represent the City <br />in all proceedings in court or before any administrative <br />body and in such other matters and controversies as he is, <br />by resolution or ordinance, directed to prosecute. He or <br />an Assistant Director of Law shall act as Prosecuting <br />Attorney for the City. He shall perform alI other duties <br />now or hereinafter imposed upon city solicitors by the laws <br />of the State of Ohio unless otherwise provided by ordinance <br />of the Council and shall perform such duties as Council <br />
