CITY OF NORTH OLMSTED <br />ORDINANCE N0. 75 - `~Q <br />Page 4 <br />and the Mayor may impose upon him consistent with his office. <br />In the absence of the Director of Law for any reason, the <br />first assistant director of law shall perform all the duties <br />herein imposed upon the Director of Law." <br />Proposal 4: That Section 3 of Article V of the Charter rela- <br />ting to the Director of Finance be amended to increase the term of <br />office from two (2) years to four (4) years, to provide the method <br />of filling a vacancy in his office, and to establish a procedure for <br />his removal by Council under certain circumstances, such amended <br />Section 3 of Article V to read as follows: <br />"ARTICLE V <br />SECTION 3: Director of Finance <br />The Director of Finance shall be on a full-time basis, with <br />his office to be conducted from the Municipal Building, and. <br />shall be the head of the Finance Department and the Fiscal <br />Officer of the City. Commencing with the regular municipal <br />election in the year 1977, and every fourth (4th) year there- <br />after, he shall be elected for a term of four (4) years. <br />His term shall begin and he shall assume office on the first <br />day of ~7'anuary next following such election. No person <br />shall be eligible to be the Director of Finance unless he <br />shall have been a qualified elector and resident of the City <br />for at least two (2) years immediately prior to the date <br />of his election, and shall continue to be a qualified elector <br />and resident of the City during his term of office. The <br />Director of Finance shall at the time of his election be <br />either a certified public accountant or a registered public <br />accountant with a minimum of five (5) years public or pfivate <br />accounting experience immediately preceding his election. <br />In the event the office of Director of Finance shall become <br />vacant for any reason, the Mayor shall appoint a successanr, <br />subject to confirmation by a majority of the members of <br />Council, to serve for the unexpired term or until the elec- <br />tion of a successor for the unexpired term at the next <br />regular municipal election provided that, (a) such election <br />shall occur more than two (2) years prior to the expiration <br />of the unexpired term, and (b) the vacancy shall have occurred <br />more than one hundred twenty (120) days prior to such election. <br />Upon concurrence of two-thirds of the members of Council; <br />the Council may, after public hearing, remove the Director <br />of Finance from office for his disqualification while in <br />office, for his conviction while in office: of a crime <br />involving moral turpitude, or for a violation of his oath <br />of office. Prior to such removal action, the Director of <br />Finance shall be notified in writing of the charge or <br />charges against him at least ten (10) days in advance of <br />any hearing upon such charge or charges and he and his <br />counsel shall be given an opportunity to be heard, present <br />evidence, and examine any witness appearing in support of <br />such charge or charges. <br />
