In the absence of the Director of Law for any reason, the first assistant director of law shall perform all the duties herein imposed upon the Director of Law." Proposal 4: That Section 3 of Article V of the Charter rela- ting to the Director of Finance be amended to increase the term of office from two (2) years to four (4) years, to provide the method of filling a vacancy in his office, and to establish a procedure for his removal by Council under certain circumstances, such amended Section 3 of Article V to read as follows: "ARTICLE V SECTION 3: Director of Finance The Director of Finance shall be on a full-time basis, with his office to be conducted from the Municipal Building, and. shall be the head of the Finance Department and the Fiscal Officer of the City. Commencing with the regular municipal election in the year 1977, and every fourth (4th) year there- after, he shall be elected for a term of four (4) years. His term shall begin and he shall assume office on the first day of ~7'anuary next following such election. No person shall be eligible to be the Director of Finance unless he shall have been a qualified elector and resident of the City for at least two (2) years immediately prior to the date of his election, and shall continue to be a qualified elector and resident of the City during his term of office. The Director of Finance shall at the time of his election be either a certified public accountant or a registered public accountant with a minimum of five (5) years public or pfivate accounting experience immediately preceding his election. In the event the office of Director of Finance shall become vacant for any reason, the Mayor shall appoint a successanr, subject to confirmation by a majority of the members of Council, to serve for the unexpired term or until the elec- tion of a successor for the unexpired term at the next regular municipal election provided that, (a) such election shall occur more than two (2) years prior to the expiration of the unexpired term, and (b) the vacancy shall have occurred more than one hundred twenty (120) days prior to such election. Upon concurrence of two-thirds of the members of Council; the Council may, after public hearing, remove the Director of Finance from office for his disqualification while in office, for his conviction while in office: of a crime involving moral turpitude, or for a violation of his oath of office. Prior to such removal action, the Director of Finance shall be notified in writing of the charge or charges against him at least ten (10) days in advance of any hearing upon such charge or charges and he and his counsel shall be given an opportunity to be heard, present evidence, and examine any witness appearing in support of such charge or charges.
