<br />The Building Commissioner reported that a total of thirty-one building
<br />permits, covering a valuation of $337,680„00, have been issued during
<br />the month of June. He advised that he has checked on the plat books and
<br />they are being compllsd at the present time and should be received within
<br />two or three weeks. Mr. Gundy referred to the letter read at the Council
<br />Meeting of July lst from the Chamber of Commerce relative to the property
<br />located between Brookpark Road and Lorain, east of Canterbury, and requested
<br />that his department be advised as to any ciecision, inasmuch as he has two
<br />applications covering that particular area; namely, Royal Castle and J. M.
<br />Fields. Mr. Gundy requested that permission be granted to Mr. James Zarbock
<br />of 6588 Charles Avenue to address Council relative to the problems Which rye
<br />has encountered due to improper grading.
<br />It was moved by Mr. Hinkel, seconded by Mr. MacDonald, that Mr. Zarbock
<br />be permitted to address Council. "Yeas" Hinkel, Hixson, Kramer, Lynch,
<br />MacDonald, O'Neill, Wilson.
<br />Mr. Zarbock described the deplorable drainage condition which exists cn
<br />his property due to the fact that proper grading was not established. A
<br />Great deal of difficulty has resulted both on his property and on his
<br />neighbor's which, naturally, has resulted in ill-feeling.
<br />Mr. Gundy then advised Council that this :is merely one of numerous complaints
<br />which he has received relative to the problem of grading and stated that he
<br />was appreciative of Mr. Zarboek's cooperation in addressing Council, in
<br />order to help them to understand the true importance of the situation and
<br />to realize the necessity for regulations governing grading.
<br />The Engineer advised that the developers ,io submit plans indicating improve-
<br />ments but he has not seen any plans showing the overall drainage. In the
<br />future he intends to require a topographical sketch to be submitted in
<br />connection with all subdivisions he passes on. Mr. MacDonald emphasized.
<br />the fact that actually it would also be necessary to have a final grade
<br />inspection after the bulldozing operation; and he stated that he was of
<br />the opinion that grading inspections shou:Ld be incorporated into our
<br />Building Code. The Mayor pointed out the fact that actually our present
<br />fees would not cover inspections of this type. Mr. O'Neill stated that
<br />this problem was presented before Council before and that it should not
<br />be dropped but should be submitted to the Safety Committee, in order that
<br />it be incorporated into our Building Code.
<br />It was moved by Mr. O'Neill, seconded by IKr. Hinkel, that the study of
<br />the grading problem be turned over to the Safety Committee. "Yeas"' Hinkel,
<br />Hixson, Kramer, Lynch, MacDonald, O'Neill, Wilson.
<br />Mr. Hixson requested an opinion as to the legality of compelling a developer
<br />to put in sanitary sewerm on any future development, inasmuch as we cannot
<br />actually give this service. This problem had been turned over. to the Flat
<br />Committee. The Solicitor advised that it is not actually enforceable until
<br />such time as the sewer lines can be tied :in.
<br />Mr. Wilson advised that it was the recommendation of the Finance Committee
<br />that the claimant, Mr. Nicholson, be afforded property damages in the
<br />amount of $280.94 in connection with the accident which occurred on Grace
<br />Road, wherein Mr. Nicholson's automobile :hit a raised man-hole cover.
<br />The Solicitor stated that it will be necessary to secure proper releases
<br />before issuing payment of the claim.
<br />Ordinance No. 2718 was introduced by Mr. MacDonald. An ordinance authori-
<br />zing the Board of Control to enter into a salvage contract. It was moved
<br />by Mr. MacDonald, seconded by Mr. Hixson, that the statutory rule be
<br />suspended and the ordinance be read immediately the second and third times
<br />and put on its passage. The affirmative vote on said motion was as follows:
<br />Hinkel, Hixson, Kramer, Lynch, MacDonald, O'Neill, Wilson. Thereupon, the
<br />ordinance was read the second and third tames and put upon its passage and
<br />the affirmative vote thereon was as follo°~-s: Hinkel, Hixson, Kramer, Lynch,
