<br />requesting Council to take under consideration and to act upon the following
<br />situation:
<br />Contributions to PERS by members of the Department prior to becoming
<br />members of the Relief and Pension Board have been refused refunding
<br />according to law because of the Wm. Biddulf claim. It has previously
<br />suggested by PERS that all contributions of the City and by members
<br />of the Department to PERS from the effective date of the Relief and
<br />Pension Act in the year 1947 be refunded upon the submission of such
<br />a written proposal by the City Council and Pension Board, contingent
<br />upon the Pension Board accepting all liability of the Biddulf claim
<br />giving credit to the refund to be made of all payments heretofore
<br />made by PERS on the Biddulf claim. The Board requests Council's
<br />favorable action in ~oini_ng with it in making such a written proposal
<br />to FERS so that the status of all members of the Department in the
<br />fund can be clarified and the difficulties existing rectified.
<br />It was moved by Mr. O'Neill, seconded by Mrs. Lynch the Solicitor be author-
<br />ized to draw up a proposal for the Firemen's Relief and Pension Board.

<br />The Auditor stated that he had bills from John R. Cloyd, the Engineer for
<br />the preparation of plans and specifications for Barton Roald, Lorain Road,
<br />Columbia Road and Canterbury Road, ordered by Council. Due to the sidewalk
<br />opposition by the residents, the Council stopped the sidewalk Program, except
<br />by petition, and requested the Engineer to stop work on the plans and specifica-
<br />tions. The Auditor stated that the only way he could pay Mr. Cloyd would be
<br />to transfer funds.
<br />Resolution No. 2658 was introduced by Mr. MacDonald. A resolution transferring
<br />funds to pay the Engineer for expenses incurred. It was moved by Mr. MacDonald,
<br />seconded by Mr. Kramer, that the statutory rule be suspended and the resolution
<br />be read immediately the second and third dines and put on its passage. The
<br />affirmative vote on said motion was as follows: Hinkel, Hixson, Kramer, Lynch
<br />MacDonald, O'Neill, Wilson. Thereupon, the resolution was read the second
<br />and third tirses and put upon its passage and the affirmative vote thereon
<br />was as follows: Hinkel, Hixson, Kramer, Lynch, MacDonald, O'Neill, ~~dilson.
<br />Mr. Oviatt read a communication from the IJational City Bank in which they
<br />stated they would make a loan to the City on a note relating to the
<br />X205,700.00 for the sewer program. The rate of interest would be 2~ until
<br />maturity, 2-1~2~ after maturity or extension of maturity one year, and a
<br />maximum extension additional year.
<br />Resolution 2659 was introduced by Mr. Kramer. A resolution authorizing thE:
<br />Director of Public Service to advertise for bids for 1500 tons of slag of
<br />various sizes to be used iri 195$ City road program, and declaring an emergency.
<br />It was moved by Mr. Kramer, seconded by Mr. MacDonald, that the statutory rule
<br />be suspended and the resolution be read immediately the second and third t~smes
<br />and put on its passage. The affirmative vote on said motion was as follows:

<br />Resolution N4. 2660 was introduced by Mr. I~a,cDonald. A resolution direc ing
<br />the Clerk of Council to advertise assessments for the improvement of Fitch
<br />Road, by constructing therein a five foot concrete public sidewalk on both
<br />sides thereof from Butternut Ridge Road southerly to the southerly City line.
<br />It was moved by Nlr. MacDonald, seconded by Mr. Hixson, that the statutory
<br />rule be suspended and the resolution be read immediately the second and
<br />third times and put on its passage. The affirmative vote on said motion
<br />was as follows: Hinkel, Hixson, Kramer, Lynch, MacDonald, O'Neill, ~dilson.

<br />Ordinance No, 2661 was introduced by Mr. Hinkel. An ordinance authorizing
<br />the Tvlayor, Clerk, and Service Director to enter into a memorandum agreement
