Mr. <br />West went on to say he wanted everybody to understand that once something is <br />zoned commercial anything that is included in the commercial class can be <br />located there and the developer does not have to commit himself as to exactly <br />what it is going to be, so if the people wanted to know if there is going to <br />be a Woolworth's or drug store or grocery store, Mr. West did not know and <br />there is no answer to that right now. <br />Mr. Schmidtke sthen asked if the rezoning goes through and Brookpark is extended, <br />approximately how close would the road go. The map was referred to and shown. <br />Mr. Schmidtke then stated there is a gentleman in the room who might be able to <br />give an answer as to what is being planned and was referring to one of the <br />developers. He directed this question to Mr. DiBenedetto. <br />Mr. DiBenedetto said he does not have anything planned at the present time. <br />He hasn't consulted with anyone at this time. <br />Mr. Schmidtke stated to Mr. DiBenedetto that they had talked about this two <br />years ago in terms of an office building. Mr. DiBenedetto stated at the present <br />time he does not have anything specific to go in there. Mr. Schmidtke asked if <br />it can be anything - even an Uncle Bill's. <br />Mr. West answered yes - that is correct - from a gas station, a Giant Tiger, <br />Uncle Bill's, grocery store, drug store, MacDonald's, etc. Mr. West said he <br />wanted to make sure everybody understands this. <br />Mr. A. Johnns, 4793 Carsten Lane asked what is the normal legal process of this <br />move, and why are developers so anxious to give us a road for nothing; what is <br />the purpose? Is it because when the land is commercial they will build buildings <br />on it - is that why they are giving us a free road? <br />President 0'Neill stated he thought Mr. 3ohnns answered that himself. Mr. Johnns <br />then stated that this actuallywas never said why developers are doing this - 3ust <br />that they are kind enough to give us a road. <br />Mr. West replied these gentlemen are out to make a profit. <br />Unidentified People remarked "at our expense". <br />President 0'Neill at this point stated there hasn't been any action taken as <br />yet and asked the people to bear with Council. He stated we will listen to <br />all of your comments and the gentlemen around this table are not going to dis- <br />regard them. <br />Mr. West then described procedure of developer in answer to Mr. Johnns question <br />as to normal legal process. He stated developer proposes layout to Planning <br />Commission. 'I'hat Commission has studies on it, etc. The Planning Commission <br />makes recommendation - either turn it down, request changes, etc. and then sends <br />their recommendations to Council. It then goes to Design & Platting Committee of <br />Council. They meet with developers, go over plans and recoBUnendatian of Planning <br />Commission, and then make recommendation to Council. If they recommend that it <br />be accepted an Ordinance is requested from the Law Director and legal description <br />C put thereon. It comes up before Council for a first reading. Next meeting it <br />comes up for a second reading and at that time a date for a Public Hearing is <br />set and that must be at least 30 days after the second reading. Notices have to <br />be sent out to all property owners within 500 feet of the rezone property at least <br />10 days before public hearing advising them of what is going to be discussed at <br />this hearing. <br />
