Puhlic Hearing 4-27-70 Page -6-
After Public Hearing the Design & Platting Committee and the rest of Council
meet and discuss pros and cons and decide whether it is to go on third reading,
and pass it or reject it, at any subsequent meeting. Generally it is not the
next meeting, and in this particular case it is my recommendation that it not
be the next meeting so we can study it. This will come up at some future meeting
and it will either be passed or rejected. Tonight is the Public Hearing and
there will be not vote taken.
At this point Mr. Johnns asked if he should have received notice by this time.
Mr. West answered yes if he is within 500 feet. Mr. Johnns stated he did not
receive notice and he said he checked with some of his neighbors and they did
not receive a notice.
President 0'Neill then asked if anyone else in the audience who lives within
500 feet did not receive notices. Mr. Foldesy and Mr. Boehm, both of Leenders
Lane, stated they had not. Thier sublots nos. are #40 and #41. President
0'Neill stated he did not know what to say. He was informed that all notices
were sent out first class mail and they should have received them. At this
time the cards from which notices were sent out were referred to. President
0'Neill asked if the two gentlemen had received a letter addressed to Blossom
Land Corp. or Beachwood Builders, as the latter were shown as owners of these
sublots. Mr. Boehn stated he has lived there for 2 years and Mr. Foldesy said
the same.
Mr. Murray, 6818 Charles, asked if the three new members are going to be permitted
the right of three readings, inasmuch as the first reading was on December 16, 1969,
before they took office. President 0'Neill stated the three members will vote on
this piece of legislation. Mr. West stated the legislation will have had three
readings; one in December, second reading in January with new members, a reading
tonight, it will be read again on third read-ing, so in fact they will have had
three readings when considered by Council. Mr. West also stated we have had as
many as six readings of a particular Ordinance.
Mr. Bruce Olseth, 4567 Ashbury Park, asked if Council feels there is a need for
additional commercial property to be zoned, and also asked Councilman Boehmer if
he has had a reading from people in this area as to their sentiments.
Mr. Boehmer answered he has heard from many residents on Dover and in Pine Ridge
Development and everyone he has talked to are against this. He stated he could
make a committment now. He will vote according to what the residents want and
sympathizes with everyone down there.
Mr. Olseth again asked if Council feels there is additional need for commercial
property in the City.
President 0'Neill said he was not about
Mr. Olseth should be fair enough to let
given them an opportunity to discuss it
and passage or rejection.
to poll Council at this point and that
Council hear everybody's objections and
before bringing it up for final reading,
Mr. Donald Thoennes, 28446 North Park, asked whether the traffic survey showed
this would be going westward beyond Dover. Felt the old time businessmen between
AVW
