<br />Resolution No. 70-82 was introduced by Mr. West. A Resalutian authoriz-

<br />pension of rule requiring three separate readings, seconded bq Mrs.

<br />Under old business, LMr. West moved for approval of 14syor's appointment
<br />of Mr. B,??rnard Schultz to the Board af Building Codes af Appeal. This
<br />motion was seconded by Mr. Limpert. Affirmative vote Boehmer, Grady,
<br />Hodgins, Limpert, Prokasy, Speedling, West.
<br />Mr. West inquired as to status of Louann, Nancy, Terrace dedications.
<br />Mr. Watts and Mr. Karhan answerad evexything is completed except drainage
<br />behind Simonelli's and grinding of the pavement at the corner of Atzgela
<br />and Nancy. Mr. tdest asked if the lot on Nancy & Angela has been sold.
<br />He was answered "mo"; has been advertised twice. Mr. West, Mayox Christman
<br />and Mr. Kitchen discussed sale of the lot, money spent on improving of
<br />1ot and how the City can recover money spent on improvemeaft and upkeep of
<br />lot.
<br />At this time rir. West inquired as to the round*ng out of the land recrea-
<br />tion west of Spruce School. Mayor Christman answered th$t this is the
<br />area where I 80 will cross Stearns and at this time it is questionable
<br />whether or not the entire Mariner narcei will be taken by the Highway.
<br />Before the City wauld go in and tr}r to appropriaCe it, he feels that
<br />the highway should make this determination. The highway also has to
<br />negotiate for some Isnd with the City and at this time there could be
<br />a trade made. Mr. West then asked for a report from our Law Director
<br />in connection with our lawsuit on water ban with the City of Cleveland.
<br />Mr. Kitchen replied the City of Cleveland filed amotion foz an exteneion
<br />of time which he opposed, and he expects a caurt ruling on it tonmwrow.
<br />He also assured Council he will press to have this heard just as early as
<br />possib le.
