Council Minutes 3-3-70 <br />-3- <br />Ordinance takes effect. Mr. Prokasy atated-the Zoning Map actually <br />is not changed. Mr. West euggested having Enginser print msp and <br />have it for next Council meeting. Mayor Christman rep2ied we are <br />awaiting tha thirty day periad in case of a petition that would prevent <br />this law ar.d does not feel map should be printed until it is in fact a <br />laca. <br />Mrs. Francis Shade, 29587 Larain Road, stated in reference to Ordinance <br />No. 69-210 she was disappointed that there were not at least two votes <br />against this Ordinance, and stated people are being stuck with no <br />privileges because of the passage of this Urdiaance. She was questioned <br />by Mr. Prokasy as to what her objections were to this Ordinance. Mrs. <br />Shade replied she expected the new members to vote against this Ordisnce. <br />Mr. Prokasy asked again specifically what her objections were. Mrs. <br />Shade fr."i.t there was nothing she could do with her property noca. Mr. <br />Proka^•,r -?<plained in detail that this Ordiance did not change her property <br />and ma;'e it clear the only change was in landscaping a 7' frontage in <br />connection with her praperty. This landscaping of 7' in front would not <br />change the side of anq commercial lot line to anything less. Mx. Prokasy <br />stated r_he 7' landscapiug in front is a matter of safety and improving of <br />appeararze of properties. <br />Mr. C. Conerly, 4996 West Park Drive, representing the West Park Associa- <br />tion, asked how can the sewers bp acceptable ta the City when the contractor <br />is still haviag trouble? Mayor Christman replied the sewers have been <br />tested and accepted for the maximum amount of infiltration. The reason <br />for the assessment being made at this time on Contract 15 and Ccmtract 16 <br />is the cost to the City is around $500. per day, and because appraximately <br />95% of the caork above ground has been done, it was felt with notes coming <br />due the City would be saving on the interest on these notes by issuing <br />bonds as quickly as possible, Mr. Conerlq questioned sewer charge and <br />asked about prorating charge from Febxuarq lst until Citq accepts sewers. <br />Mayox Christman said he was aware that some of the sewers on North Park <br />would not pass infiltratian test but it was felt this could be corrected <br />on time. It was corrected on March 3rd. Discussion as to prorating sewer <br />charge was broug'htt up; will not appear on water bi11 until May. Mayor <br />Christman felt refunding o€ a monthlq sewer charge would be a camplicated <br />procedure, and he would not be one to recommend thfa extens3on until May <br />and refunding would be up to Gouncil. Mr. Conerly referred to sidewalks <br />being installed; felt that people sre burdened with sewers at this time <br />and questioned holding up on sidewalks. Discussion between Mr. West and <br />Mr. Conerly continued as to the area and homes affected. Mr. West expla3ned <br />we do need the s3.dewalks for the eafety of children and people, aad felt <br />we do need to provide them whether ar npt they are used. Mr. Fxokasq stated <br />the sewers are installed first so as not to have to dig sidewalks up at a <br />later date. <br />Mrs. Gladys 2ipp, 29658 Lorain Road, asked if she will have to pay for <br />replacing of sidewalks. She was answered not sidewalks that have besn <br />damaged by sewer construction. <br />
