Council Minutes 12-16-69 <br />-2- <br />Mr. Weat, Finance Conmittee Chairnian, said this comanittee has met <br />three times since last Council meeting. 1wice to discusa 1969 balance <br />of appropriations and 1970 budaet, incleding revisions needad far bus <br />line salaries, vacations, etc. They are just about finished with work <br />on 1970 budget. Thep also met with Recreation Conm?ittee to go over <br />their budget and did make aome revisions. The Recreation wf.ll resubmit <br />the budget. <br />Mr. Prokasy, Chairman of Design & Platting Ccrmnittee, reported the fol- <br />lawing: 1) Clingmsn Subdiirisiaa to be he].d in coemittee uzitil develaper <br />complies with City regulattons fn 1)eerpath Subdivision; 2) S. D. C. This was requasted becsuse of numeraus complaints about <br />traffic problem at that iateraection, and particular complaints from pro- <br />pertq owner, Mr. T. Gall.agher. <br />Also discussed by above mantian+ed ca?mm,i.ttee: Ordinance No. 69-131, which <br />has had its secand raading, as amended, and ie set for a Public Heez3ng. <br />Date for Public fl++earing wi11 be 'i`hutsdaq, Pebruary Sth, 1978, S:QO p.m., <br />in the Commuaity Cabia. Ordiaamce No. 69-210 is to be amended before <br />reading tonight, then placed on aecand reading as awnded. This will then <br />also become a part of the Public Hearing on February 5, 1970, at 8:00 p.m., <br />in the Communitq Csbia. Ordinauce No. 69-210 is to be amended per Plan- <br />ning Commiasion's reccia'ttdatic?aa. Also on Agenda tonight will be the <br />Arthur Allq Subdivision No. 69-213. The Silk Subdivisian has been approved <br />by Plaaning Commi::icm (dividing thrae lots into two). The Ally Subdivi- <br />sion No. 2 hes been apprc>ved 1?y Planniag Gemmissiaa, and is nvw in cos+mi.ttee <br />for study. The Westerly Tflwers resoning xequest for hi-rise to retail busi- <br />ness, located in front of FiArdwick House apartment on Lorain Read, has been <br />aQproved by Plsaning Commission, end also is readq to be studied in comaiittee. <br />President of Council 4'Neill then reported he had received a Certigied <br />letter, dated December 4th, fxom Carole Jo Hanzes Moroaey, capiee of same <br />having been sent to Counci].sen Proicasq, West, Miller, Limpert, Hndgins, <br />Eian, Caster. Letter read as folloas: "Dear Mr. 0'Neill: In reply to <br />Council's letter to me of Novamb+er 19 and the minutes of Couucil's aeeting <br />of November 5, 1969, I reitsrate that the Charter of the Gitq of Narth <br />Olmsted provides specificallp €or a hearing ?j Council regarding the quali- <br />fications of a cotancilman. 'ghesre is no provision therein for a detera4iAa- <br />tion by the Law Direetar of the facts aad the law relating to such qualifi- <br />cation. In additian, I remfnd Council that testi.nany and ewideace have not <br />been presented becauae of Cauncil's refusal to set a time and place for the <br />hearing of auch evidence.
