<br />Minutes of Public Hearing - 12-10-70 <br />-2- <br />property also and John Knox's property drains into it too. He wondered if the <br />ditch will be adequate to take care of all that storm. <br />Mr. West said if it isn't the developers are going to have to build it big and deep <br />enough to take care of it. Mr. Karhan said it will be adequate; also, in talking <br />with Mr. Antol have discussed putting retention in parking lot but all indications <br />seem naw that they will not need it. <br />Mr. John Withers, Columbia Road Baptist Church, asked as the new Columbia Road <br />comes through will there by any revision in the drainage ditch? What will be <br />the responsibility of owners of the ditch when they want to get across to the <br />new Columbia Road? <br />Mr. Antol stated if he went through their property it would be with drain tile <br />and filling same over. Also, he will leave a connection for property to drain <br />into. Understands that at a future date it will all connect to a new Columbia <br />Road storm system. <br />Mr. Karhan said the State has not resolved the drainage yet on the road. Had a <br />preliminary meeting and discussed drainage, but have not come up with any particular <br />answer. <br />Mr. West explained that the improvements plans will have to be approved in detail. <br />Anyone interested will be invited to such a meeting to see the drainage, deepness <br />of ditch, whetlter it will be tiled, etc. All of the details will be worked out <br />at that time and if it is not satisfactory, it will not be approved. <br />Mr. Henry Janik, 24940 Lorain Road, pointed out the property he owns and property <br />owned by his daughter, Judith Herman. Asked if the assessments for sewer, street, <br />sidewalks, if any, will be assessed against them, in view of the property they own. <br />Mr. West said no - they will not be assessed against their property - only a public <br />road. <br />Mr. Janik asked if this will have any direct effect on the zoning as it stands <br />now on Lorain Road for the other property? Mr. West said it will not. <br />Mr. Janik asked if a buffer zone will be provided and width of same. Mr. Rosenthal <br />said there is a 20 ft. buffer zone to the garages or parking which must be landscaped. <br />Mr. Janik pointed out property owned by his daughter and speaking in her behalf, <br />commented there is not accessibility as to ingress and egress unless she trespasses <br />onto his property. Feels she could be landlocked - no provision as he sees it on <br />maP • <br />Mr. Antol said they have no intention of landlocking. Have brought the roadway <br />down to the property and stated Judith Herman will have ingress and egress. <br />Mr. Janik wants a right-of-way and an easement incorporated in legal form to a court <br />of record to see that this is maintained on a permanent basis. Mr. Janik stated the <br />deeds they have ncyw show that they have a permanent right-of way and easement <br />through this section from Lorain Road up to an including their property so that they <br />4D are not landlocked now. <br />Discussion continued.
