Council Minutes of 12-1-70 '6a <br />LEGISLATION: Resolution No. 70-171 which had beea introduced bp Mr. <br />West was given its third reading. A Resolution accepting fur recording <br />purposes only the KemQer Subdivisicra. Mr. West moved for ad€?ptian of <br />Resolution, secoaded bq Mr. Grady. Affirmative vote Boebeer, Grady, <br />Hodgins, Limpert, Prokasy, Speedliag, West. Motion Carried. <br />Resolution No. 70-212 which had been introduced by Mr. We:t was given ite <br />third reading. A Resolution acceptiag fnr recarding purposes onlq the <br />re-subdivision of OZmsted Woods Subdivieion on Beilevue Drive and Psialeq <br />Drive and approviag tlze impraveaent plans of said subdivision. Mr. Weat <br />moved for adoption of Reeolution, aoeconded by Mr. Boehmer. Affirmatine <br />vote Boehmer, Grady, Hodgi.ns, Limpert, Prokasy, Speedling, West. Motion <br />carried. <br />Ordinance No. 70-127 which had treen intraduced by Mr. West was g3ven its <br />second reading, as atmended. Aa Ordinance sneading the Zcme Map adapted <br />as part of Ordinence No. 62-33 (knawn as the Zoniag Code of the C3ty of <br />North Olmsted) by chaagiag the designation thereon of certain laad from <br />its preseut designation thereoa as B Residence District to Mu2tiple Resi- <br />dence District. <br />Regarding Ord. 74-127, Mr. taest stated that his Comnittee had camgleted <br />the work on same. Planaing Covmiseion has agreed w3.th the changes and, <br />therefore, this Ordinance will have its third reading at next Council <br />meeting on December 15, 1970. <br />At this time Mr. Grady made a motion that Council postpone the second <br />reading of Ordinance 70-166 and, in the alternative to refer to Pl.anning <br />Commission, and second reading to cccur when it comes back fron P1anning <br />Comad.ssion. Motion was seconded by Mr. Limpert. <br />President 0'Nei11 asked if there were aay questions regarding motion. <br />Mr. West sCated he feit Mr. Grady is out of ordex fram the standpolnt that <br />it is up to the Building, Zoning & Develope4ent Conmittee to refer thfs <br />ordinance to the Planting Cami.ssion. <br />Law Director Kitchen advised that the motion bq Mr. Gradp is not in order. <br />If Mr. West wants to refer ordinance to the Planning Commiosiass, as Chair <br />40 man of the Building, 2oning & Development CoTmmittee, he can do so which is <br />what pir. West ha@ earlier 'stated he was going to do. <br />President 0'Neill requested Mr. Grady to withdraw hi$ motion from the <br />floor and Mr. Limpert to withdraw his second. <br />Mr. Grady withdrew his motion and Mr. Limpert withdrew his second. <br />Mr. West made amotian that Ordinance No. 70-166 be referxed to the <br />Planning Commmission. Motion was secanded by Mr. Prokaey. Affirmstive <br />vote Gradq, Aodgins, LimQert, Prokasy, Speedling, West. Abstaining from <br />vote - Boehffier. Motion carr3ed. <br />Mr. Boehmer in accordance with the Charter and Rules of Cauncil staLed <br />his xeason for abstaining from voting. Mr. Boehmex 'stated his resson
