Council Minutes of 11-20-73 -3- <br />approval of this installation on the basis that the parking, ingress and egress <br />and general layout was being approved. If there is any violation to the Cade <br />(Sect. 1173.02) it should be an administrative matter regulated by the Building <br />Commissioner and Mayor. <br />Mr. West moved that Council approve the parking and layout of the Red Pax <br />Restaurant-Tavern, seconded by Mr. Giesser. <br />Mr. Prokasy discussed the Code's stipulations and directed questions to Law <br />Director Kitchen. Mr. Kitchen cited two decisions: City of Lyndhurst attempted <br />to do the same thing and Cart had held the State has preempted the control of <br />liquor and sale of liquor in one instance; another instance the Court stated no <br />municipality has the right to attempt by zoning to control a liquor permit. <br />Mr. Kitchen pointed out the only thing before Council at the present time is a <br />building. The liquor permit will hays to be transferred under the Statute and <br />Council will have before it at that time of transfer a right to abject to the <br />transfer. Discussion continued. <br />ROLL CALL ON 1~TION: Affirmative vote: Giesser, West. Negative vote: Prokasy, <br />Saringer, Speedling: Abstained: Boshmer. 3 Nays - 2 Yeas - Motion defeated. <br />Mr. Prokasy, Chairman Streets & Drainage Committee and Recreation, Public Parks <br />& Building Committee, verified that a motion of Council would be sufficient valid <br />authority for resubmission of recreational grant to the Government. <br />Mr. Prokasy moved the recreation praQosal for the development ~d acquisition <br />of lands previously submitted bs resubmitted to the Department of Natural <br />Resources. Motion seconded by Mr. Speedling. Affirmative vote: Boehmer, Giesser, <br />Prokasy, Saringer, Speedling, West. Motion carried. <br />Regarding proposed Recreation Cae~lex, Mr. Prokasy referred to recommendation <br />of Planning Commission that there be a subcomatttee consisting of tNO Planning <br />Commission Members, two Council l~embsrs, two Recreation Commission Members, to <br />do the hatch Sob on proposal to meet prapased budgets, and to start the inter- <br />viewing of architects for screening in this area. Committee will not make final <br />decision on anything without the three bodies involved. <br />Mr. Prokasy moved that Council approve a Committee to be composed of two members <br />of Planning Commission to be appointed by Planning Commission, two smsbers of <br />the Recreation Commission to be appointed by Recreation Commission, trio rs <br />of Council to be appointed by Gouncil President, and the Safety Director repre- <br />senting the Administration, to fLStetion as a Committee overseeing the Recreation <br />Complex Proposal and to make recoamsndations to all three bodies. Motion <br />seconded by Mr. Speedling. Affirmative vote: Boetmzer, Giesser, Prokasy, Saringer, <br />Speedling, West. Motion carried. <br />People addressing Council: <br />Mr. Charles Miner, President of North Olsmted Senior Citizens, addressed Council <br />regarding Department for Elderly. <br />Mr. Jack O'Donnell, 564$ Decker Rd., addressed Council regarding Department for <br />Elderly and Department of Human Resources. <br />Mr. Dennis Wise, b451 Surry Drive, verified vote regarding Red Fox Restaurant- <br />Tavern. <br />
