Council Minutes of 9-20-77 -a- <br />~ $2,056. for eassrgency repairs to a wastewater treatment lugger truck: it is <br />~ Mr. Fairfield's understanding this happened quite awhile back and it is up to <br />Council to approve this expenditure which basically is in violation of our City <br />Charter. Mr. Wilamosky stated he agrees -this isn't the first time Council had <br />to take some action to correct an irregularity in relationship to the garter; <br />one of which was the purchase of chemicals at the Treatment Plant; another was <br />the repair of a packer truck and the latest is the repair of the lugger truck. At <br />last meeting Mr. Wilamosky indicated to the Adotiaistration that Coun~:il wanted to be <br />notified before they take any similar aviation in the future because in the last three <br />occasions we are talking about $3t3~. to $4,400. for the repair of a packer truck; <br />another $2,000. for a repair here and tl~ouaaawla of dollars far the purchase of <br />chemicals. Mr. Wilamoaky, for one, doses not want to continue to have to take this <br />type of ratifying and confirming-action to correct as irregularity: thinks Council <br />should be notified prior to -whether by phoet~e or letter -but indicate to Council <br />and hopes the Administration will follow through on that recoamendation before they <br />go ahead and do as they have done in the past. Mr. Fairfield discussed the <br />approval of chemicals under emiezgsncy that were purchased in three different <br />segments at the beginning of the year; and at that time he voted na on it and he <br />was assured it would not happen again aaa~l we are doing it again:. Now if this is <br />in violation of our Charter them a~-ybe the State 1titor ought to look at this or <br />we ought to look at it here. giants to solves "the p~cobl~t, etc. President Lampert <br />stated he does now know why Cc>vncl waits until the third reading to question the <br />legality of a piece of legislation: it was put on first reading aaaad at that time <br />if there were any questions as to the legality of it they should have been brought <br />up then and not wait until third rag and bring out questions at that time. <br />Mayor Christman stated he would like to eaic in defense of the Administration: <br />There is a provision in times of a~rergea+cy that it caa~not go through the bidding <br />procedure: our bidding l~eits in jiorth ©lmsted is $1,000. -probably one of the <br />lowest in the State: the State is new $3,500. The truck broke down: its duty is <br />to haul the sludge.froaa the treataa~t plaaat: when you take that truck in to get <br />the engine repaired you ~ not i v4at is amide that engine. Now we could <br />either wait and get an estirwste for fisting it for whatever it was and sometimes <br />you cannot even da that, sad thaaa g+~t legislation, then advertise for bids and <br />get it fixed and let the sludge build up; or we could get it fined: we got it fixed <br />and thinks that was proper. Mr. Fairfield aa-ked Mayc+r Christmaar- was it the proper <br />decision to purchase chemicals in three ate purchases. Mr. Caster stated hs would like to coarsa~rmt: when we were <br />presented the bill Mr. Weldon camas to Coasacil at a regular meeting and explained <br />the circumstances and at that point legislation etas asked for. Mr. Wilamosky said <br />be believes Mr. Weldon explained that bill in Caucus Room and it was sometime <br />thereafter the repair was made; and Mr. Wilas~osky's only request to the Administra- <br />tion is that in a case like this to call Council or send them a meaa4o to that effect <br />so we can anticipate what action is ga~S to be taken; so the wos~ is not. done and <br />then we are presented with a hill two or three months after the work has been <br />completed: that is the only thing he is asking fax.
