Council Minutes of 1-18-77 -7- <br />A Resolution declaring the necessity of constructing certain concrete sidewalks <br />Resolution No. 76-189 introduced by Mx. Wilamosky was given its third reading. <br />A Resolution directing the Auditor of Cuyehoga County to pay to the City of <br />North Olmsted, Ohio during the year 1977 all tax money due aad owing said City <br />from any collection source. Mr. Wilamosky moved for adoption, seconded by <br />Mrs. Sharpe. Affirmative vote: Beaty, Baeh~er, Fairfield, Beringer, Sharpe, <br />West, Wilamosky. Motion carried. Res. No. 76-189 adopted. <br />at Brendan Lane and Brookpark Road Extension, pro~v:.~rg that abutting property <br />owerns construct the same, and declaring an emergency. Mrs. Sa~-!nger moved for <br />adoption, seconded by Mr. Boebsa~r. Affirmative vote: Beau, Hgeltmer, Fairfield, <br />Beringer, Sharpe, West, Wilamosky. Motion carried. Res. No. 76-187 adopted. <br />Resolution No. 76-192 introduced by Mxs. Sharpe was given its third reading. <br />A Resolution accepting for recording purposes only the Shore West Construction <br />Company Subdivision in the City of North Olmsted. Mrs. Sharpe moved for adoption, <br />seconded by Mr. Beaty. Affirmative vote: Beaty, Boehmer, Fairfield, Beringer, <br />Sharpe, West, Wilamosky. Motion carried. Res. No. 76-192 adopted. <br />Ordinance No. 76-I93 introduced by Mrs. Sharpe was given its third reading. <br />An Ordinance accepting a grant of right-of-way from the North Olmsted Board <br />of Education for the extension and widening of Duane Road in the City of <br />North Olmsted. Mrs. Sharpe moved for adoption, seconded by Mr. Beaty. Affirmative <br />vote: Beaty, Boehmer, Fairfield, Beringer, Sharpe, West, Wilamosky. Motion <br />carried. Ord. No. 76-193 adopted. <br />Ordinance No. 76-194 introduced by Mrs. Sharpe was given its third reading. <br />An Ordinance granting an easement to Cleveland Electric Illuminating Company <br />and Ohio Be11 Telephone Company for the installation of underground electric <br />transmission Linea and underground communication lines to be located over and <br />through City property in the City Line Estates Subdivision in the City of <br />North Olmsted. Mxs. Sharpe moved for adoption, seconded by Mx. Beaty. Affirmative <br />vote: Beaty, Fairfield, Beringer, Sharpe, West, Wilamosky. Abstain: Boehmer. <br />Motion carried. Ord. No. 76-194 adopted. <br />Ordinance No. 77-2 introduced by Mayor Christman was given its second reading. <br />An Ordinance amending Section 911.03 entitled "Charges Generally" of Chapter 911 <br />entitled "Sanitary Sewerage System Charges" of the Codified Ordinances of the <br />City of North Olmsted, and declaring an emergency. <br />Ordinance No. 77-3 was introduced by Mr. Wilamosky. An Ordinance providing for <br />the submission to the electors of the City of North Olmsted of a proposed <br />amendment to the Charter of the City of North Olmsted relating to the limitation <br />on the amount of taxes that may be levied by the Council of the City without <br />a vote of the people, and declaring an emergency. Mr. Wilamosky moved for <br />suspension of rule requiring three separate readings, seconded by Mxs. Sharpe. <br />Mr. Fairfield asked Law Director Gareau for a ruling on whether it is within <br />the legal limits of Council to move this ordinance under suspension of rules. <br />Law Director Gareau stated his opinion and it has been on other occasions is <br />the method for amending the Charter is basically set out in the Constitution <br />of the State of Ohio. He believes and he has discussed this with bond counsel <br />that 1t is probably not necessary to read it three times and also it is not <br />necessary, in Mr. Gareau's opinion, to put an emergency clause in it because <br />he believes that it takes effect immediately anyway.
