<br />been any case law with respect to this and Mr. Gareau suspects that rather to
<br />be safe than sorry, to incl~:de the waiving of the *..:.ree readings and also the
<br />passing on emergency, because somebody at a later date might challenge it and
<br />there is no sense in taking a chance. Law Director Gareau explained the purpose
<br />of the emergency clause; also the purpose of a 30 day wait is so that any
<br />citizen can circulate referendum petitions to have the matter placed on the
<br />ballot. This is a Charter AOendment - this is going on the ballot anyway.
<br />Mr. Gareau stated reasons why he does not believe it is necessary to go three
<br />readings and go on emergency; but it is in there because there is a potential
<br />conflict with our own Charter that says every ordinance must be read on three
<br />separate occasions.

<br />Ordinance No. 77-4 was introduced by Mr. Wilamosky. An Ordinance to make
<br />appropriations for current expenses and other expenditures for the City of
<br />North Olmsted, Ohio for the year ending December 31, 1977. Mr. Wilamosky moved
<br />for suspension of rule requiring three separate readings, seconded by Mr. West.
<br />Affirmative vote: Beaty, Boehmer, Saringex, Sharpe, West, Wilamosky. Negative
<br />vote; Fairfield. Mr. Wilasky moved for adoption, seconded by Mr. West. Mr.
<br />West explained this was left off from the appropriations which Council passed;
<br />the bill is due and has been for quite so~petime and the Rec Center has now the
<br />funds and he thinks we aught to pay the money. Mr. Fairfield stated if they
<br />waited this long they certainly could wait far three readings. Roll Call on
<br />Adoption: Affirmative vote: Beaty, Boehmex, Fairfield, Saringer, Sharpe, West,
<br />Wilamosky. Motion carried. Oxd. No. 77-4 adopted.
<br />Ordinance No: 77-5 was introduced by Mr. Boehmer. An Ordinance designating
<br />the Council Chambers located within the confines of Citq Hall as being a place
<br />of public assembly where no smoking is permitted and declaring an urgency.
<br />Mr. Boehmer moved for suspension of rule requiring three separate readings,
<br />seconded by Mr. Beaty. Affirmative vote: Beaty, Boehmer, Fairfield, Saringer,
<br />West, Wilamosky. Negative vote: Sharpe. Mr. Boehmer moved for adoption,
<br />seconded by Mr. Beaty. Mayor asked if this has to be passed by the end of the
<br />month; Law Director Gareau discussed the section of the Ohio Revised Code.
<br />Discussion ensued. Roll Call on Adoption: Affirmative vote: Beaty, Boehmer,
<br />Fairfield, Saringer, Sharpe, West, Wilamosky. Motion carried. Ord. No. 77-5
<br />adopted.
<br />Resolution No. 77-6 was introduced by the Mayor and the entire Council. A
<br />Resolution commending the public service of Councilman John J. Goggin, Jr.
<br />Mrs. Sharpe read resolution in its entirely. Mrs. Sharpe moved for suspension
<br />of rule requiring three separate readings, seconded by Mr. Boehmer. Affirmative
<br />vote: Beaty, Boehmer, Fairfield, Saringer, Sharps, West, Wilamosky. Mrs. Sharpe
<br />moved for adoption, seconded by Mr. Boehmer. Affirmative vote: Beaty, Boehmer,
<br />Fairfield, Saringer, Sharpe, West, Wilamosky. Motion carried. Res. No. 77-6
<br />adopted.
<br />Ordinance No. 77-7 was introduced by Mrs. Sharpe and given its first reading.
<br />A Resolution accepting for recording purposes only the Revere-Butternut Subdivision
<br />in the City of North Olmsted.
