Council Minutes of 1-~i-77 -2- <br />.Law. Director Gareau reporteda 1) in~the last Session the Ohio Legislature adopted <br />legislation whereby all City°Prosecutors in municipal iaw departments are now <br />hands~d the raze opportunity to try all of_the Img~lied Cuns~t and 12 Foint cases <br />with respect to .driving suspensions of Bureau of'ffiotor Vehic°lea. There is a <br />provision in the Ohio Revised Code that when-the City handles these types of <br />matters that the-County will provide -for compensation, Around December 30th <br />,received a packet. with S case~e but -have not received any method of compensation. <br />Will.~.be looking at that in the next month --it is a iot of work with nv more pay. <br />Law Director Ga7eau explained what-.this will entail. <br />~aw:Di.rector Gareau and Mr. West discussed the new Privacy Act and the interpretation <br />of same.. Law Director Gareau pointed out one of the problems with the ~'rivacy <br />Law is although it is going into effect tote Agency that impiementa the rules and <br />regulations has not issued any standards. <br />Mrs. Beringer, Chairman Streets & Drainage Committee, stated ,the meeting which <br />was .scheduled for tommorrow evening Frith the Eq~ualixation Board for Mill Road <br />sidewalks hes been cancelled. After conferring with Bond Gounsel 1!bcs. Beringer <br />was informed that it would not be necessary and a aeeeting of the Streets b Drainage <br />Committee and the Equalization Beard was discouraged because the Equalization Board <br />is supposed to be an independent body and should prat 'have to confer with Council; <br />2) regardag the passage of the resolution creating the Equalisation Board - it <br />is unfortunate that the Board was not sworn in before hearing the ob3ections. As <br />a result we will have to go through that procedure all over again. <br />Mr. Boehmer, Chairman Intra Goverr~ntal Relations & Legis~,ation Committee and <br />Public Safety, Health & Welfare Committee, reported: 1) Maxies, inc,, 4905 <br />Great Northern Blvd., has applied for a D-1 permit and Committee has no objections; <br />2) with respect to Council's ap~intment to the Recreation Comurti®sion: Mr. Robert <br />Swietyniowski was appointed to fill the unexpired term of Mr. Koontz, term ending <br />12/317b. Legislation ~omAnittee feels that Mr. Swietyniowski should be reappointed <br />to serve a five year term commencing 1-1-77 to i2-31-81. <br />Mr. 8oehmer moved to appoint Mr. Robert Swietyniowski as Council's appointment to <br />the Recreation Commission for term 1-1-77 to 12-31-$~., seconded by Mrs. Sharpe. <br />Affirmative vote: Beaty, Boehmer, Fairfield, Beringer, Sharpe, West, Wilamosky. <br />Motion carried. <br />3) the recommendations for appointments made by Mayor Christman to the various <br />Boards wall be discussed at meeting on January 6th. <br />Mx. Wilamosky, Chairman Finance Committee, reported: 1) Committee recommends <br />Ord. No. 77-1 be adopted under suspension of rules so that the Finance Department <br />will have su-fficient funds to pay debts over the next three months; <br />2) pFior to Council Meeting Ord. No, 77-1 was amended to include an additional <br />$500, to provide for Architects ~ Appzaisers and explained reason .therefor; <br />3) Mx. W3.lan~sky stated Council has heard from Mayor Christman tonight that he <br />will introduce Ord, Mo. 77-2 which deals with a bOX increase in the sewer rate. <br />Mr. Wilamosky stated a week ago, the Mayor, Law Director and Mr'. Wilamasky met <br />with Mr. Wayne Kuhn and Mr. Row3inson, Bond Counsel, to discuss some alternate <br />methods of paying and funding the debt service and other aspects of the Treatment <br />Plant. And at that point Mr. Kuhn was going to prepare some additional figures <br />for Council to review. Also discussed the alternatives to 'a user fee type rate <br />as described in Ord, No. 77-2.
