Council Minutes of 1-4-]7 -5= <br />~+ Ordinance No. 76-185 introduced by Mr. West was given its third reading. An <br />~i Ordinance ratifying and confirming the purchases of hydrogen peroxide (Tysul) <br />which were used on an experimental basis over a period of approximately one and <br />one-half years at the Sewage Treatment Plant, ~Mr. West moved for adoption, <br />seconded by Mrs. Sharpe. Mr. .Fairfield asked for discussion cQmmenti~tg he has <br />read the Legal Opinion of the Law Director on same and he is disturbed to find <br />this practice has been committed twice - asked how do the people lcnb~v they are <br />getting the best price on these chemicals if they are not purchased-properly or <br />bids put out and asked Law Director Garesu if it is necessary to pans this legis- <br />lation so that the City is protected from a lawsuit. Law Director Gateau explained <br />he has be~i assured by the Service Director that the best price was obtained in <br />the marketplace for these items axed that they were purchased on an experimental <br />basis Law Director .Gateau, stated in his opinion one and pne-half years is a little <br />bit too long -especially. in reviewing some of the purchase orders which were issued <br />on the same date for amounts wader $1,000. Thinks the City received a benefit from <br />.the chemicals - also the standpoint of at least perm~.tting~the Director of Finance <br />to pay these bills which we are morally obligated to pay even if there are some <br />questions with respect to legality. In effect-what the Council is ~irig is ratifying <br />'and confirming what has .taken plact°in the past,:and with the assurance that in <br />the future we are not going to have Che same problem. Service Director Caster and <br />City Engineer Childs gave their counts. Mr,. Wilamosky gave his comments and <br />feels there was an error and perhaps poor judgement used when the chemicals were <br />purchased and hopes that incidents such as this will not occur in the future and <br />the Charter will be followed. Mrs. Sarin~er stated she would like to reiterate her <br />feelings and would hope that this practice does not continue in the future. Dis- <br />cussion continued. <br />ROLL CALL ON ADOPTION: Affirmative vote: Beaty, Boehmer, Saringer, Sharpe, West, <br />Wilamosky. Negative vote: Fairfield. 6 Yeas - 1 Nay - Motion carried. Ord. No. <br />76-185 adopted. <br />Resolut~.on No. 76-186 introduced by Mrs. Saringer was given its second reading. <br />A Resolution declaring the necessity of repairing and replacing cert~~.n~concrete <br />sidewalks at sundry locations within the City of North Olmsted, providing that <br />abutting property owners repair. and replace the same, and declaring an emmergency. <br />Resolution No. 76-187 introduced by Mrs. Saringer was given its second reading. <br />A Resolution declaring the necessitq of constructing certain concrete sidewalks <br />at Brendan Lane and Brookpark Road Extension, providing that abutting property <br />owners construct the same, and declaring an emergency. <br />Resolution No. 76-189 introduced by Mr. Wilamosky was given its second reading. <br />A Resolution directing the Auditor of Cuyahoga County to pay to the City of North <br />Olmsted, Ohio during the year 1977 all tax money due and owing said City from any <br />collection source. <br />Resolution No. 76-191 introduced by Mrs. ~1'-arpe was given its second reading. <br />A Resolution accepting for recording purpo~peo~only the $edication of Country Club <br />Boulevard Extension which is to be used .for roadway purposes in the City of North <br />Olmsted. Mrs. Sharpe moved for suspension o~ rude requiring three separate readings, <br />seconded by Mr. .West. Affirmative ~ot::Beaty, -Boehmer, Fairfie~.d, Saring~er, Sharpe, <br />West, Wilamosky. Mrs. Sharpe moved for adopft~on, seconded by Mr. West. Affirmative <br />voter Beaty, Boshmer, Fairfield, SaringQZ, Sharpe, West, Wilamosky. Motion carried. <br />Res.
