e <br />Council Minutes of 10/6/81 '2- <br />Law Director Gareau reported: 1) Since the 1a3:: ::canril Meeting, the Supreme Court <br />of the State of Ohio xefused to take in the RTA Case. Peinted out one interesting <br />fact: to date, the Maple Heights Case ie still pendittg and-will probably he taken in. <br />',?ith the possibility of filing a separate action in Federal Court, an the bauaie af <br />anti-trust, the Law Department has dcme 60 hours of research and Law Director feels <br />City has a viable cause of actfon. Feels the threats made by Mr. Ron3.s during <br />negotiations about running parallel and ccmpetiag lines and putting the City of <br />North Olmsted out of business ccrostitute mee?nupalistic practises that are vrohibited <br />by Federal ].aw. Law Directar feels.the case is complicated but can be handled <br />"in house"; expects case will be filesd in Federal Caist witlzin the next twa days. <br />2) Another case that has been going bsek ar?d forth is the "°penay fall" caae. Lven <br />though it is entitled "knigtsts of Calumbus versus the City of North Olmsted'", the <br />'Cnights of Columbus have been out of the case for a long time and it is the crwner <br />of the penay fall machines who is cantinuing the agpeal. About three month8 ago, <br />the Court dismissed the appeal because certain thinga weren't dor?e properly by the <br />attorney purauing this. Tadsy, Law Directar receivecl notice that the case was again <br />dismissed from the Court of Appesle on the basis that their attorney failed to file <br />a brief. It is very unusual to heve a case reinstated after failure to file a <br />brief so this slould be the end of this caae. <br />3) 3ad initially indicated a trial date of October 6th on the ja11 standards case. <br />That date was chsnged; ncyw have a new briefing schedule because everqcne sgreed that <br />instead of having a trial, mvtions for sumiat'y 3udgmnt would be fil.ed. Is presently <br />preparing a motion for summary jiulgment with aunn aeccmpanying brief which ehould be <br />submitted by October 30th. The other side is dMg the sase. Reply is due by us <br />on November 15th. <br />4) Last week, submitted a motion for =untaz'q judgment in the Police Pensicm Fire <br />Disability Case together with accompanyin8 brief. This has been set dowre €ar oral <br />argument later this moath. <br />Sarety Director Petre re;?orted: 1) The current residential code was publislied in <br />early 194-I`s; is no longer in nrint; is obsolete. BZD Cammittee i+embers have re-- <br />ceived material from Building Ccmmnissioaer for revieca. VanKuren and Ca-ptain Qsterhouse travelled to Almira, i3eca `_'ork, to <br />inspect the new numper? found several minor corrections or c'.Aanges need to be r,iade, <br />expect delivery in the near future. <br />4) Next ''ednesdav, Faill advertise for bids for the new nolice cruisers and fire <br />vehicle, pZus radics for both departmeats. <br />5) Baseball diamond on City property at C'_iestnut School has heen completed. <br />Diamond I?o. 1 at North nlmsted Park has a new arass infield, the first one in the <br />City. <br />6) loard of Control ai=arded the Barton/nradley fence pro3ect to the Cyclone Fence <br />Division of U. S. Steel in the amouat of $20,053.78 <br />7) In 1930, hacl five game rooms o?erating at five locations iaith a total of 71 <br />nac'iines. In 1^31, have nine loeations with 123 machines and total income generated <br />for the 1980-81 period is 55,670. <br />+ 3efore moving into Committee Reports, President Limpert announced that Ordinance <br />'io. 81-117, with respect to the coatrol of all electrical capaeitors located in <br />the City, has been added to tonight's agenda.
