: <br />Council Minutes of 9/15/81 <br />-3- <br />2) Is preparin¢, and should file this weelc, a motion for summary judgrtent in the <br />Firemen ,mnd Police Pension Case. <br />3) 'Jith respect to the jsil standards case, has been in contact with the Attorney <br />General's office and instead of having a trial the first week of Oetaber, LJiZI <br />submit this to the Court on sumary 3uagment. 3asica3ly this means there'fs no <br />dispute in facts; it is 3ust a matter of law; will submit a brief and if the <br />Court so desires, will have an oral argument. <br />In the absence of Mrs. Saringer, Chairmaa intra-C=owernmental Relations and Legis- <br />lation Co?aittee, Mrs. Petrigac moved Council spprove the appoinimce:nt of <br />Mr. Ronald Bugala to the Board of Zoning Appeals, seconded by *ir. Loaan, unani- <br />mously approved. <br />Mrs. Petri-aac, Chairman Fnvironaental Cantrol Coneaittee reportede 1) Carmnittee <br />met Tuesday, September 8th, vi.tb a21 membexs present. Also in attendance were <br />Hayor Swietyniawski, president Limpert, and two residents - Mr. A1 Aaskell and <br />iir. '"ill Giesser. Committee went outside and looked at the G'EI capacitor right <br />here on Dover Center Road. Camcilman Boehmer explained how to tell if they were <br />a hazard or not. Mr. Boetuaer also provided a broehure, published by CEI, entitled <br />"Information about PCBs far employees of the Illumfaating Company'°. The 14-ayor pro- <br />vided a 14 page pass-out from the MayorB an.d Momagers Associatitn who recamnend <br />iaaiting to see the true dsngers of FCBs ss they ptzrsue their imrestfgstion. rtaqor <br />Swietyniawski does not feel the poles stxuld be marked at this point becauee they <br />would be a target for vandsli:erm. A€ter atuch diseuasion, the majority of the <br />co?mittee decided to studq th3.s furthuer before mak3ng a recamendaticm. Since the <br />decision was not unanimous, the legislattian is on seccmd reading tonight and hepefully <br />a cammittee recommendation will be given so that it will be back on t'hird reading at <br />the next council meeting. Siuce the meetiag, Mrs. Petrigar has talked with <br />Lyndhurst Councilmen Gliesser who originated the legislation that aur ordinance is <br />based on. Councilman Giiesser prawided a Iist of other people tn oEher eommunities <br />that could furnish additional infovmtitra. Maqor Anter of Fairview stated that <br />their poles were marked in a red and white check type pattern and tltey wrote "PC'V <br />on the poles. CEZ then marked the poles in a b3.ack sad yellaw triangle, Tvf.th a <br />warning on them. 'Aayor Anter aIso ncrtified a11 residents of the procedures to be <br />taken in the event the capacitars become hatzardcxis. l3asical.ly, the people were told <br />to call the Fire Departmeret or the Pa].fce 13cpart^ansnt urho wpuld come out and rope off <br />the area. ??irs. Petrigac wi11 be setting up another Envinormental Meeting to dis- <br />cuss this further. <br />Mro McKay, Building, Zoning aad Deveicrpment Casnmittee meraber reported: 1) BZD <br />Comittee met September 14th and discu:sed a number of signs. Mr. McKay moved <br />Council approve a facia sign as submitted by the Body Wrap, 267I9 Brookpark Exteasion, <br />seconded by t+tr. Boelmter, unantmmsIp approved. <br />2} Mr. McKay moved Couacil spprcxve a facia sign with the Yeccxnmendations of the <br />Architectural Review Baard €or The Good Baok Store, 4876 Daver Center Road, seconded <br />by rTr. Logan, unanimvusly agproved. <br />3) Mr. McKay moved Council approve the ground sign background as submitted to <br />Council by Great Northem Corpc?rate Center9 secanded by Mr. Logan, unanimously <br />approved. <br />4) Mr. McKay moved Council approve the new business and facia siga as recctmended <br />by the Architectural Reveiw Board for Chuck E. Cheese, APCt3A Theatre Restaurant q <br />Lorain and Clague Road, secanded by Mr. Boetmer. Roll call an sotion: Affirmative <br />voCec Boehmer, ?°IcRay, Petrigac, Woetpel. Abstained: Lagsci. 4 Ayes - 1 Abstention - <br />s•totion carzied.
