f <br />E <br />t <br />Council *%'[inutes of 9/15/81 -4- <br />Letters and Communicationsa <br />Clerk of Council announced receipt of a petition opposing the Christ the King <br />Cotmnunity rezoning request, located on the west sfde of Barton Road between I-480 <br />and the North Olmsted south corporation iine and including extensfon to Carcrk Road. <br />This petition is in objection to the praj*ct's initial concept presentaLictYt and all <br />other presentations_which would inclucle development vther than single fami.ly homes. <br />People addressinp, Council: <br />Representative from Chuck E. Cheese asked if both the facia sign and the plans had <br />been approved by Mr. McKay's motion; felt that Mr. IcKaq's motion did not inelude the <br />plana. iir. '4cKay adviBed that he did say "netv business'° in his mofiion. <br />`4r. Mel Dieterich, 26068 Kenneady Ridge Road, again stated that there is excessive <br />use of the eneergency clause in the iegislation. AIso, last week, Council passed <br />nine pieces of legislaticm under mopension of the rule requring three readings.; <br />why have three readinge i€ they aere not used? Mr. LoQan and Finance Director <br />Broctaaan explained the neeessity far the etcticm that Council took. <br />TRrs. Rita Limpert, 23810 iMaple Rfdge Rosd, auggested that Council explain the time <br />limitations to Mr. Dieterich since legislation on emergency involvee a time lapse <br />period. <br />14r. Robert Stackhoase, Olmsted Township, asked for a clarificatian regarding the <br />Christ the King Church projeet. Mayor 'Srrietyniawski suggested they discuss this <br />immediately after the Cauncil Meeting. <br />LEGISLATIpN: <br />Ordinaace No. 81-102 introduced by *Zr. Wilamosky was given its second reading. An <br />ordinance authorizing the issuance of ttotee in anticipation of the issuance of <br />bonds for the pumose of gurchasing trucks, automob3.les and other motcrrized <br />equipment, together with the necessary appurtenances thereto, for various depart- <br />ments of the Citq, and declaring an ener$ency. Mr. Boehmer moved far suspeusion <br />of rule requiring three readings, seconded by Mr. Logan, unanimausly $pproved. <br />"4r. Woerpel moved for adoptian, seconcled by Mr. Logan, unanimausly approved. <br />Ordinance t1o. 81-102 adopted. <br />Ordinance No. 81-103 introduced by Mr. Booi3mer was given its second reading. An <br />ordinance establishing permit and fee requirements for the use of all baseball <br />diamonds, fields, and faeilitiea caperated and falling under the 3uriediction <br />of the Recreation Departme°nt of the Citq of ATorth Olmsted, and repealino Ordin- <br />ance No. 79-136. <br />Ordinance No. 81-104 introduced by Mrs. Petrigac was given its second reading. A <br />resolutian urging the Cleveland Electrie Illuminating Camtpauy to pronnptly identify <br />and remove as soon as pcrasible, sIl electrical capacitars ncxa lacated in the City <br />of North Olmsted Which are constiCUting a hazard to the general public. Mr. Logan <br />moved Council amend Ordinmee No. 82-104 to include a Section 3, regealing the <br />existing Section 3, that vgauld entez the eiaetgeacy clause stating that this ordin- <br />ance be declared an emergency measure imediately neceassry for the preservation <br />of the public health, safety and weifare of the citiaens of North 0lmsted and <br />further, provided it receives the affirmative vate of two-thirds of all Members of <br />Council, it shall take effect atxd he in force fvaediately upon its paseage and approval <br />by the i!Zayor, seconded bq Mr. Woergel. Rv31 call on notion: Affirztative vote: <br />Logan, MctCap, Petri.gae, Woergel. Abstained: Aoetmer. 4 Aqea - 1Abstention - <br />Motion carried.
