The <br />permanent replacement for the culvert is nroteeding with a number of steos and <br />apProvals for this partfcular aroject to be grae?ted bq the Federal Highway Admini.stra- <br />tion. Proper procedures for right-of-voy acguisition metst also take piace. Had a <br />meeting today with officia2s ftcun the Canuttq regarding the use of same Connnunity <br />Development Block Grant funds to gay a portion of the materf.al cost. <br />4) Regarding the Clague Road recoRatsucticn, ie preparing another submissian of the <br />plans to the County this week. Projected date for thiB particular project is Octaber <br />of 1982. <br />5) ?rofiling of the Daventent for the reconstruction of Dover Ceater Road has been <br />essentially completed by C1evelsnd Trinidad. PaCeh work will be done tomorrow, prior <br />to the application of the slurry seal by Ajas. Final submission for F and IC revie-w <br />I will be sometime in September. <br />5) Several meeti.ngs and conferencea have been held with officials from the ClPVeland <br />Electric Illwninatir?g Campanq regarding the street illuminat3on projects pro?osed to <br />be completed with Community Development Block Grant funds. <br />7) Engineering De:)artment dra€tsam, Seen Bpiand, has resigned after three 37ears of <br />service; are currently conducting intervime for a replacement. <br />8) Harold L. rlichaels, head of @ts School of Civil Engineering at Purdue University, <br />will be in Clevelaad on October $th to reeeive an award preseated by the American <br />Society of Civil Enoineers. He will be speaking vn the topic of public works <br />facilities and the need for emp}xasis by the civil engineer on maintenance re- <br />habilitation and continued investment ia auch facilfties. Tickets are availeble <br />from rir. Zurawski. <br />Law Director Gareau reported: 1) Is presently workfng on a brief to be submitted <br />to Federal Court regarding the drug paraphernelia case. City of iiorth Olmsted had <br />filed an action in Comman Ploas Cctiurt to enforee the ordinsnceY the people from The <br />Right Place filed an actian the same day in Federal Court, a8king the Court declare <br />it unconstitutional. It is Mr. Gareau's vpinion that the Federal Court shoa.l.d <br />abstain from jurisdiction, dismiss the ce,se, and have 1t tried in the State Court <br />system. <br />2) Had submitted a brief to the Supreme Court on the RTA Case; received a brief <br />from the Regional Transit Authoxity two days ago and is preparing a reply to it. <br />3) Had renorted previously Chat the itush Case had been certified to the Supreme <br />Court because there was a coa€Zfct with aqaother Aggellate Court re,arding nrocedural <br />problems encountered in the case. Supreme Court ruled in favor of our <br />Appellate Court Diatrict; ecrosequently, Law Director contacted the Rush attorney <br />and asked that theq voluntarilq df.ssiss t'heir apgeal. [ahen they refused to do so, <br />rir. Gareau filed a imotion ta aismi.ss. <br />4) Regarding the Rnights of Columbus Case, City had grevailed in the laaer court. <br />They appealed this to the Caurt of Apgesls; failed to file a praecipe9 the Court of <br />Appeals dismissed the case. They then filed a motion to reinstate the case9 Court <br />p;ranted the motion; Law Directar will now have to write a brief in this case. <br />5) During August, filed six Bui3.d#.ng Diepartment complaints where prosecutions were <br />sought. One of these was Len Derin Dodge who no longer have cars parked in the <br />front set back area.
