<br />2) Member Petrigac asked Ruilding Commissioner Gundy several questions including
<br />those pertaining to a pole building for equipment at Ma.rtyn's Auto Shap on Lorain
<br />Road; completion date for the fence at the Hyde Park Development and the prolifer-
<br />ation of new pole signs on Great Northern Boulevard. Commissioner (;undy indicated
<br />he would investigate and report back.
<br />3) Following up on discussion at the Planning Commission Meeting of October 25th,
<br />Mr. Woerpel indicated that legi.slation would be forthcoming regarding requests to
<br />amend the ordinance not allowing pole sign poles to be illuminated from within as
<br />well as legislation amending Ordinance No. 79-139 with regard to grantin.g variances
<br />which establish or plat lot lines without approval or input from the Planning Cammission.
<br />4) As discussed in caucus tonight, there is some concern with regard to the interpre-
<br />tation of Sections 1133.15 and 1133.16 with reference to the Board of Zoning Appeals.
<br />Is concerned specifically about the Ianguage in Section 1133.15, which states that
<br />within three days of any ruling of the BZA, it shall be sent to the Clerk of Council,
<br />who shall present said ruling, determination or order at the next regular Meeting of
<br />Council for its consideration and review. With that language in mind, Mr. ?aoerpel
<br />referred Council to the minutes of the B7.A meeting on October 5th, 1983, and asked
<br />if anyone wished to take any action, pr_o or con, with regard to the request for an
<br />extension of a special permit for St,Brendan Parish at Brendan Lane and Reed Avenue.
<br />In caucus, Council had also discussed the ruling of the BZA on the 7th of September
<br />with regard to the definition of a"through" lot. The Law Director gave his
<br />recommendation and explained the circumstances under which the BZA agreed with his
<br />opinion on September 7th. However, Mr. r,Joerpel is not entirely comfortable with
<br />this and at this ti:me moved Council overturn the decision of the Board of Zoning
<br />Appeals, on September 7, 1983, with rep,ard to the request by Rini's Supermarket, Inc.,
<br />26035 Lorain Road. (There was no second to Mr. Woerpe?'s motion.)
<br />5) It was apparent during the course of the year that Council, through the Bui,lding,
<br />Zoning and Development Committee, could work to bring the Planning Cotppaiission, the
<br />Architectural Review Board and the Board of Zoning Appeals much closer together for
<br />the development of consistent policy within the City; would take this mament to
<br />recommend that whoever sits on the BZD Com¢nittee next year continue to work in concert
<br />with these volunteer boards and commi;ssions for the future planning of the City.
<br />6) Next meeting of the Planning Com¢nission will lie Thursday, November lOthz next
<br />BZD Committee meeting will be Thursday, December lst.
<br />Mr. McKa.y, Chairman Environmental Contr4l Cvmmittee as well as Publi,c Safety, Health
<br />and Welfare Committee reportedt 1) Combined Safety/Transportation Committee meeting
<br />was held Tuesday, October 25th. Pres3.dent Boehmer, Safety Director :Petre, Councilmen
<br />Woerpel and McKay were in attendance. Couanittee discussed. Ordinance No. 83-119,
<br />creating a 15 minute loading zone at the Cotmnunity Cabin. Mr. McKa.y moved to amend
<br />Ordinance No. 83-119, Section l, to add "beginning at the south building line and
<br />proceeding north twenty-five feet", second by Mr. Logan, unanimously approved.
<br />Ordinance No. 83-119 so amended and placed back on second reading.
<br />2) Briefly discussed the need for a polygraph operator. No classes will start until
<br />after the first of the year; this will be looked at in the new budget.
<br />3) Committee discussed Ordinance No. 83-123, demolition of a residential dwPlling at
<br />25710 Lorain Road and has no ob.jection.
<br />4) Committee discussed Resolution No. 83-130, contract for the health care with the
<br />Cuyahoga County General Health District and has no objection.
<br />5) Mr. McKay moved Council have no objection to the issuance of a n4 liquor permit
<br />for VFW Post 7647, 24345 Lorain R.oad, second by Mr. Bierman, unanimously approved.
<br />? 6) Moved Council apnrove the placement of the newspaper receptacle at the North Olmsted
<br />Recreation Center this weekend, second by Mrs. Petrigac. Roll call on motion:
<br />Affirma.tive vote: McKay, Petrigac, Saringer. Negative vote: Bierman, Logan, tailamosk.y,
<br />Woerpel. Motion failed. Mr. Bierman moved the Administration place the recycling
<br />container west of the City Center, on the asplialt, second by Mr. ?aoerpel, unanimously
<br />approved.
