Council Minutes of 6/5/84 -2- <br />Finance Director Boyle reported: 1) City has received the money from the City of <br />Cleveland for sewer billings through February 1st - $337,000 for North Olmsted and <br />$9,571 for the Township. Cleveland is withholding $11,000 from North Olmsted and <br />$327 from the Township for delinquencies so the 3y withholding for delinquencies <br />is now at $85,294.96. They had proposed a contract to withhold 3y and pay it back <br />annually, after their audit; annually is now up to six or seven quarters. <br />2) On June 1st, City paid its bond and coupons, $345,000, most of which is paid out <br />of property tax; $10,700 out of interest earnings. <br />3) Received notification of the special assessment disbursement; check will probably <br />arrive tomorrow, in the amount of $118,000. $280.80 delinquents; $267 interest on <br />those delinquents. <br />4) Governor Celeste, tomorrow, is to sign legislation, passed by both Houses last <br />Thursday, allowing municipalities to go twenty years on notes. It had been eight <br />years back in 1982; in May of 1982 it went to ten years and now is supposed to go <br />to twenty years because the long-term market is fairly unstable and costs munici- <br />palities high rates. <br />5) City has a new hospitalization bill which is lower than it had been. This was <br />paid on May 22nd and will save the City approximately $2,700 per month. <br />Law Director Gareau reported: 1) There is still a little misunderstanding with <br />respect to the implications regarding the Supreme Court's refusal to accept the <br />anti-trust case with regard to RTA. Most Council Members realize that this really <br />doesn't change the ruling that the State Courts have made relative to RTA's position. <br />Unless the City of North Olmsted agrees to sell the line, the only alternative, <br />other than what is being done right now, would be for RTA to run parallel and com- <br />peting lines. Law Director does not see that as a viable option. The Plain Dealer <br />editorial thinks North Olmsted should throw in the towel. Law Director disagrees. <br />Many of the people at RTA are perfectly satisfied with the system the way it is <br />right now; there is really no need to change it although there are some things to be <br />ironed out with respect to the garage facility and how it is going to be paid for <br />as far as the debt service. These things will be worked out in due time; no one <br />should panic; City has not come to the end of the line. <br />2) Back in 1980, a property owner on Louis Drive was using a single family residence <br />for two family purposes. They had a mother-in-law suite they were renting out to <br />someone else other than family members. At that time, Law Director had filed for an <br />injunction in Common Pleas Court. The case was assigned to Judge Fuerst who granted <br />a permanent injunction against having the property used for two family purposes. <br />Law Director was recently informed by the Building Department and a neighbor that <br />the homeowner was once again using it for two family purposes. Law Director filed <br />a motion for body attachment, which basically means that the Court will issue an <br />order to the Sheriff to arrest the person and bring him before the Court to answer <br />contempt charges. <br />Safety Director Petre reported: 1) Thanked Council Members and the Administration <br />for their participation in All Scouts' Weekend. <br />2) Requested that Council suspend the rule requiring three readings and pass Reso- <br />lution No. 84-47, commending the public service of Assistant Chief Richard P. <br />Limpert, since Chief Limpert and members of his family are seated in the audience. <br />Mr. Rademaker, Chairman Environmental Control Committee reported: 1) Commitee met <br />May 31st in con3unction with Finance Committee, as well as Council-as-a-Whole, to <br />consider a fourth plan, submitted by McDonald and Company and Squire, Sanders and <br />Dempsey, with respect to the improvements to the Wastewater Treatment Plant. No <br />decision was reached with respect to funding. This fourth plan combines both a <br />sewer rate increase and a millage on real estate; Council is still considering all <br />four plans at this time. <br />..„t,oq~,..~. ~,« <br />
