y <br />Council Minutes of 4/16/85 -2- <br />Law Director Gareau reported: 1) Law suit, City of North Olmsted versus <br />Fortuna Valore, has hit a snag. Mr. Valore is now deceased and Law Director <br />feels it is too early to determine whether or not his estate would have sufficient <br />funds to pay the amount the city is seeking because Mr. Valore was a relatively <br />young man with a young family. Does not feel it is appropriate to even approach <br />the question until some time in the future. <br />2) Consistent with what was reported at the last council meeting, Mr. Gareau has <br />given President Boehmer all the data received with respect to his investigation <br />of what happened to the notice of voluntary recognition of the Fire Department; <br />assumes this will be distributed to council and will be acted on appropriately. <br />3) Legislation with respect to an easement regarding Great Northern Theatre will <br />be introduced this evening. After redrafting three or four times, Law Director <br />is now satisf ied with the language and considers it appropriate. Great Northern <br />will assume all responsibility for repair and maintenance over and above what the <br />city would have spent with an "open cut". <br />President Boehmer asked that the Clerk make copies of the data submitted by Law <br />Director Gareau for distribution to the entire council. <br />Finance Director Boyle reported: 1) Received a call from Mr. Peter Ross of Mc- <br />Donald and Company advised that the city has just received its seventh straight <br />MIG 1 rating; there is a note ordinance on the agenda tonight for the sewer facility <br />renovation. Will be meeting with Mr. Ross and Mr. Kuhn to plan a bonding process <br />for the year. Right now, would like to bond all existing notes coming due <br />September 22nd, an amount of about three and a half million dollars. The five <br />million dollar issue that is to be rolled over tonight comes due in November. <br />2) County Auditor has been contacted about the amended certificate; there were a <br />few problems with. it and a new one should be received this week. <br />3) County has forwarded a list of 339 delinquent parcels of real estate, in a <br />range from $2.00 to $27,000, which is an extremely low percentage of delinquencies. <br />4) With respect to the audit mentioned. at the last council meeting, bids were re- <br />ceived by the State Auditor on Monday and will be opened and reviewed on Thursday. <br />Hopefully, agreement will be reached before the end of April. <br />Mr. Bierman, Chairman Long Range Planning Committee reported: 1) Joint meeting <br />of Long Range Planning and Recreation Committees was held on April 9th; in the <br />interest of time, will defer his report to Mrs. Petrigac. <br />Mrs. Beringer, Chairman Intra-Governmental Relations and Legislation Committee <br />reported: 1) Legislative Committee met briefly this evening; moved Council <br />approve the appointment of Mr. Michael E. Patton to serve on the Landmarks <br />Commission, second by Mr. Bierman, unanimously approved. <br />2) Recreation Co~mnission met on April 9th; approved the Softball Association's <br />proposal to fence Diamond No. 4 at a cost of $5,824 and to install an electronic <br />scoreboard at a cost of $1,600, plus $600 installation fee. This will also in- <br />clude new bleachers for Diamond No. 4 at a cost of $1,300. Improvements will be <br />completed by April 27th; Commission is very grateful to them. Mrs. Sue Jones, <br />representative of North Olmsted United Soccer Team, asked for approval to operate <br />the concession stand at Bradly Field, from April 13th to June 23rd, to raise funds <br />for a trip to Ireland in July to participate in the Northern Ireland Cup. Request <br />was approved provided some questions were answered by Law Director. Commission <br />will sponsor a Fix-up and Clean-up Day; letter has been sent to all service organ- <br />izations asking for participation. Meeting has been scheduled for Sunday, April 21, <br />at 9 P.M. at the Recreation Department off ices at the Rec Complex to finalize plans. <br /> <br />
