Council Minutes of 3/19/85 -4- <br />Mrs. Linda Melda, 4286 Porter, complained of the very unhealthy, dangerous con- <br />dition of the Flagner property. Police have been called a number of times because <br />of teenagers congregating on the property, entering the abandoned house, kicking out <br />the boards covering the windows, ripping off the garage door panels, etc. Police <br />have responded but the trespassers werejust asked to leave; they were not cited or <br />arrested. Mr. Tallon stated that he had discussed this with Building Commissioner <br />Gundy who suggested that the City take care of the cleaning up and bill the owners. <br />President Boehmer stated that he would personally look into this situation and see <br />what can be done. Mayor Swietyniowski stated he would talk to Mr. Gundy tosaorrow. <br />Law Director stated that this has gone on long enough; the Mayor should direct the <br />Building Commissioner to inspect the property; if it is not 50~ salvageable, he <br />should immediately proceed to condemn the property; send the notice of condemnation <br />out; have legislation prepared once the notices have been sent. The owners then <br />will have an opportunity to appear before the Building Code of Appeals and after <br />that demolish the building and clear the property. <br />Mrs. Patty Fink, 28300 Nandina Drive, also described the unsanitary and unsafe <br />conditions of the Flagner property which have spilled over onto her property. <br />Has been complaining about this since April of 1984. Ts contemplating a law suit <br />against the Flagners, their contractor and the City of North Olmsted because nothing <br />is being done. There is a continuous flow of trespassers; they are never cited <br />or arrested by the police, merely told to leave. Mr. Tallon stated that he had <br />contacted Captain Marsh and was told to hive the neighbors keep calling the police. <br />The neighbors are doing so but are not satisfied with the action the officers are <br />taking when, and if, they answer the call. Asked Mayor Swietyniowski to have the <br />Safety Director look into the situation and see what can be done. <br />Mr. Jim Dufala, 4449 Ranchview_Avenue, stated that the residents on Ranchview, West <br />Ranchview and Timber Cove would like to present a petition to have these streets <br />repaired. Presented the petition. and a picture of the bad condition of the road. <br />Mr. Bi11 Lackey, 5782 Burns Road, addressed the very poor condition of the Community <br />Cabin;. it needs repairs and maintenance very badly. Two years ago, the Community <br />Council submitted a list of recommendations to Council. Nothing was done. Tonight, <br />has again presented these recommendations. There is money for the rewiring; to <br />take care of the ceiling. Why hasn't this been done? This year is the 40th anni- <br />versary of the Cabin and special activities have been planned for Homecoming. Is <br />hopeful that by the end of August, 1985, the building will be repaired, rewired, <br />repainted, etc. so everyone can be proud of it. <br />LEGTSLATION: <br />Ordinance No. $5-11 introduced by Mr. O'Grady was given its third reading. An <br />ordinance amending Chapter 533 of the Codified Ordinances entitled "Obscenity and <br />Sex Offenses" by including. therein a new Section 533.14 entitled "Possession of Child <br />Pornography", as amended. Mr. O'Grady moved for adoption, second by Mrs. Petrigac, <br />unanimously approved. Ordinance No. 85-11 adopted. <br />Ordinance No. 85-12 introduced by Mrs. Saringer was given its third reading. An <br />ordinance amending Chapter 739 of the Codified Ordinance entitled "Gasoline Service <br />Stations" by adding thereto a new Section 739.03 entitled "Air Pumps Required". <br />Mrs. Saringer moved for adoption, second by Mr. Tallon, unanimously approved. <br />Ordinance No. 85-13 introduced by Mr. Bierman was given its third reading. An ordin- <br />once providing for the submission to the electors of the City of North Olmsted of an <br />amendment to Section 2 of Article IR of the Charter of the City of North Olmsted to <br />provide that Primary Elections be held at the same time as that designated by the <br />State of Ohio, and declaring an emergency. Mr. Bierman moved for adoption, second <br />by Mr. Tallon, unanimously approved. Ordinance No. 85-13 adopted. <br /> <br />
