<br />Council Minutes of 11/5/86 -2- <br />Law Director Gareau reported: 1) As a member of the negotiating team with <br />respect to wages, agrees with the Mayor's characterization of this being <br />a difficult undertaking; it is extremely difficult to be negotiating with <br />three different groups at one time. Although there are many constraints <br />imposed by state law, negotiations are proceeding as expected. <br />2) The Halleen Light Case has been postponed many times. Both the city and <br />Halleen are trying to obtain the services of an expert. Everyone recognizes <br />there is a problem and it is simply a matter of trying to resolve it without <br />going to a full-blown trial. <br />3) Last week, spent three and a half days trying the Romp. Rezoning Case. <br />Instead of arguing the ease after it was concluded, the court is permitting <br />the submission of briefs which are due on the 14th of November. This is the <br />same day that the Cooper brief is due; it is now being typed in its final form. <br />4) Law Director realizes that some council members are a little bit concerned <br />about the proposed Fraulein's Restaurant. When he attended the Board of <br />Liquor Control hearing, Law Director indicated that he thought the Board of <br />Liquor Control should deny the permit because this property is not set up <br />for a restaurant. Rather than. deny the permit, they were given thirty days in <br />which to come up with plans. These plans have now been submitted to the city. <br />Council can rest assured that the Board of Liquor Control has indicated that <br />no permit will be issued until such time as there is a visual inspection and <br />is satisfied there are sufficient facilities to operate a restaurant and bar. <br />A permit will not be issued until an actual establishment has been investigated. <br />4) Law Department is presently in the process of typing, in its final form, <br />a brief that will go to the Sixth Circuit with respect to the Crumbley Gase. <br />Finance Director Boyle reported: 1) Has been informed by Arthur Young and <br />Company that the city audit has been released by the State of Ohio. The <br />State Auditor won't release an audit within 60 days of an election, so the <br />North Olmsted audit was held.up until today. It has now been released back <br />to Arthur Young, fully approved. Arthur Young will be meeting with the Mayor <br />and Finance Director next week; audit will then be forwarded to the Environ- <br />mental Protection Agency under the Single Audit Act which will take care of <br />the federal requirements. <br />2) City is in receipt of $14,000 from West Shore Cable far the July 1st <br />through September 30th period; this is 37 of the $468,387 revenue. <br />Mr. Wilamosky, Chairman Finance Committee reported: 1) Finance Committee met <br />jointly with the Transportation Committee. on October 28th and discussed <br />Ordinance No. 86-100, an ordinance to provide for the installation of an up- <br />dated traffic signalization system. Based on the terms of the agreement, <br />the city would pay the estimated $10,000 for the engineering cost of the <br />project. Balance of the construction cost will be shared by the city and <br />through the use of federal funds. Total cost of construction is estimated at <br />$480,000; city's share would be $120,000 plus engineering costs; federal funds <br />would total approximately $360,000. Committees.jointly recommend adoption of <br />Ordinance No. 86-100 and sufficient funds to cover this improvement will be <br />provided in next year's appropriations.. This is a 1987/88 project and Finance <br />Committee will be looking for alternative financing outside of utilization of <br />General Fund dollars. <br />2) Finance Committee discussed Ordinance No. 86-101, an inter-fund transfer <br />within the Recreation Fund and has no objection. <br />3) Committee discussed Ordinance No. 86-102, an inter-fund transfer within <br />the Sewer Revenue Fund. Committee recommends that the line item, Plant <br />Maintenance, be included; the ordinance has been amendedto reflect this <br />recommendation as well as some minor amendments; committee recommends <br />adoption of Ordinance No. 86-102, as amended. <br /> <br />
