<br />President Woerpel requested a copy of the letter sent to the insurance company
<br />by Law Director Gareau with respect to Mr. Corrigan's request for representation
<br />in the Crumbley lawsuit.
<br />Mr. O'Grady, Chairman Public Safety, Health and Welfare Committee reported:
<br />1) Moved council have no objection o the transfer of a D2, D2X, D3, D3A and D6
<br />liquor permit from the Great Northern Shopping Center, a Limited Partnership,
<br />25973 Brookpark Road, North Olmsted, Ohio, c/o E. Biskind, Biskind Development,
<br />4970 Great Northern Mall, North Olmsted, Ohio, to Buckingham Limited Partnership,
<br />dba Twilight Zone Nightclub, Great Northern Shopping Center, 25973 Brookpark Road,
<br />North Olmsted, Ohio, second by Mrs. Saringer, unanimously approved.
<br />2) Moved council have no objection to the issuance of a D5A liquor permit to the
<br />Atlas Glass Construction Company, dba Starlight Lounge 29328 Lorain Road, North
<br />Olmsted, Ohio, second by Mrs. Saringer, unanimously approved.
<br />3) Moved council have no objection to the issuance of an F2 license to the
<br />North Olmsted Community Council, 29271 Lorain Road, North Olmsted, Ohio, for a
<br />function to be held on April 24, 1986, second by Mrs. Saringer, unanimously
<br />approved.
<br />Audience participation:
<br />Jim Hebelone, 5960 Wild Oak Drive, representative and vice-president of the Timber
<br />Trails Homeowners Association, stated objections to the proposed expansion of
<br />Space Age Industrial Design. Asked enforcement of existing zoning codes and laws.
<br />Asked council to support the current community development plan for orderly de-
<br />velopment in the city. Mr. Wilamosky requested that the at-large members of
<br />council attend the Board of Zoning Appeals meeting to be held tomorrow evening.
<br />Mr. John Thomas, 6096 Wild Oak Drive, discussed the liquor permits issued to
<br />the Timber Trails Party Center; they do not appear to be in compliance with what
<br />the voters of Ward 3, Precinct K, approved when local options were placed on
<br />the ballot in November of 1976 and 1984. Law Director instructed Clerk of Council
<br />to write a letter to the Board of Liquor Control, indicating to them that there
<br />is some question about the issuance of permits in light of the local option election
<br />that took place in 1976 and 1984; ask them to immediately investigate and. advise
<br />the city as to whether or not the issuance o~ such permits is proper in light of
<br />the outcome of the vote. Mr. Wilamosky moved the Clerk of Council write a
<br />letter as directed by the Law Director, second by Mrs. Saringer, unanimously approved.
<br />Lynn Maximuk, 30817 Old Shore Drive, President of the Timber Trails Homeowners
<br />Association, suggested that liquor permits and transfer be more closely watched
<br />to be sure they were being issued legally.
<br />Dick Spaeth, 28873 Tudor Drive, representative of the West Park/Forest Ridge
<br />Civic Association, stated that this organization lends wholehearted support and
<br />backing to the statements made by the representatives from Timber Trails.
<br />Henry Reichel, 5654 Columbia Road, complimented Mrs. Jack on the good job she
<br />is doing at the Senior Center. Has been aware of the missing $200 since 1983
<br />and with the books being audited every year cannot understand why this wasn't
<br />discovered before this. Is shocked by the whole incident.
<br />Joseph Corrigan, 6369 Brighton Drive, advised council that volunteers are
<br />additional insureds under the city's general liability insurance policy. Also,
<br />his request for private counsel flows from the Crumbley law suit against the
<br />City and it is because of the City Attorney representing the City and representing
<br />public officials in their public capacity that a possible conflict of interest
<br />would arise under the canon of ethics for a practicing attorney. It is strictly a
<br />matter of professional ethics and his personal concern since he is being personally
<br />sued for punitive damages in addition to compensatory damages.
