,Counci.l Minutes of 1/7/86 <br />-5- <br />LEGISLATION (cont'd): <br />Ordinance No. 86-4 introduced by Mr. Wilamosky was given its first reading. <br />An ordinance establishing rates of compensation for various adminisCrative and <br />legislative personnel, and declaring an emergency. Referred to Finance Comm~ittee. <br />Ordiaance No. 86-5 introduced by Mr. Wilamosky was given its first reading. An <br />ordinance establishing the compensation to be paid to all hourly employees em- <br />ployed by the North Olmsted Municipal Bus Line, and declaring an emergency. Re- <br />ferred to Finance Committee. <br />Miscellaneous business: <br />Mr. Wilamosky stated his concern with Mayor Petrigac's decision to combine <br />the Safety and Service Departments under one director. Also, questioned her <br />appointment of a clerk in the Engineering Department because it violated the <br />Civil Service regulations. Requested the Law Director to comment on these <br />actions with respect to their legality. Mayor Petrigac stated that she clearly <br />understood that she could not combine the Service and Safety Departments under <br />one director without a charter amendment. She was simply going to try out <br />such a combination to see. if it would be a workable arrangement; the newly <br />appointed Director of Service, for an interim period only, was going to take <br />on both responsibilities just to see if it would be feasible. Secondly, <br />Mayor Petrigac had talked with the secretary of the Civil Service Commission <br />and only appointed a clerk to the Engineering Department when she was told that <br />there was no one on the waiting list and the Civil Service Commission could <br />not offer anyone to fill this position. When Civil Service Commission holds <br />their next tests, the new clerk will take the test at that time. If no test is <br />given within two years after her hiring, the new clerk would then be "grand- <br />fathered" into the position. Law Director Gareau stated he would give an <br />overview on the combining of the Service and Safety Departments tonight and <br />then formalize it with a written legal opinion. Mr. Gareau stated that the <br />charter specifically pxovide .. under Article V, Section 1, that there will <br />be five specific departments and not even Council can combine or eliminate any <br />of these departments. If Council can't do it, no one else can do it. Secondly, <br />there is a provision within the charter dealing with the Director of Public <br />Safety and the Director of Public Service that specifically states that these <br />individual, specific directors will not hold any other appointive office other <br />than the office they have been appointed to. While the Mayor's attempt to <br />combine the departments to save money is a laudable goal, Mr. Gareau is con- <br />cerned that even a temporary transfer of the duties of one director to the other <br />would muddy the water and the city could wind up having all kinds of problems <br />from a standpoint of litigation. In Mr. Gareau's opinion, the Mayor should <br />immediately look for someone to fill the other position of Safety Director and <br />the present vacancy can be filled by her in the interim. He would not advise <br />the Mayor at this time, nor would he advise council, to have the Service Director, <br />even on a temporary basis, assume the duties and obligations of the Safety Director <br />and he will put this in writing. <br />Mr. Wilamosky moved council appoint the following members to serve on the nine <br />Standing Committees of Council with the first named to serve as Chairman: <br />Building, Zoning and Development Committee - Janet Saringer, Ron Tallon and <br />Dennis Rademaker; Environmental Control Committee - Dean McKay, Tom O'Grady and <br />Bill Lackey; Finance Commit ee - Ron Wilamosky, Janet Saringer and Ron Tallon; <br />Intra-Governmental Relations and Legislation Committee -Bill Lackey, Ron Wila- <br />mosky and Janet Saringer; Long Range Planning Committee - Dennis Rademaker, <br />Dean McKay and Ron Wilamosky; Public Safety, Health and Welfare Committee - Tom <br />O'Grady, Bill Lackey and Ron Tallon; Recreation, Public Parks and Buildings <br />Committee - Ron Tallon, Bi11 Lackey and Dennis Rademaker; Streets and Drainage <br />Committee - Dean McKay, Ron Wilamosky and Tom O'Grady; Transportation Committee - <br />Dennis Rademaker, Tom O'Grady and Dean McKay; second by Mrs. Saringer, unanimously <br />approved. <br />
