Council Minutes of 12/1/87 -2- <br />~,, 7) Would welcome everyone's help on Saturday at ten o'clock to decorate City Hall; <br />tree lighting ceremony will be held on Sunday at 6:30 P.M. <br />8).Reminded Council that the filing deadline for a tax levy to be placed on the <br />ballot for the May 3rd primary is February 18th; special elections can only be <br />held in February and August; the filing deadline is 75 days prior to the election. <br />date. <br />9) Temporary budget will be placed in Council's mail boxes this Friday. <br />President Saringer asked if the Mayor had any recommendations with respect to <br />placing a proposal on the ballot. Mayor responded that she had read in the <br />newspaper that Councilman Wilamosky had a tax proposal; will wait to see what <br />his recommendation to council will be. Mr. Wilamosky stated his current concept <br />is not much different than what was earlier presented to council; there would be <br />a need for some marginal updating with respect to information and statistics and <br />he would be more than happy to continue to pursue it if council will give him <br />some inkling as to what direction they would like to take; would welcome any <br />input and/or comments from council; there is no question that the City of North <br />Olmsted needs additional revenues to address and resolve many of its capital needs. <br />With respect to the Mayor's comments on the Vita Lane property sale, Mr. Wilamosky <br />advised that he is sure there is a deed restriction, which could be verified by <br />the County Recorder's office, that prohibits the city from using the property for <br />anything other than recreation. If the city does not use the land for recreation, <br />it then reverts to the original owners, therefore it is not necessary to hire an <br />appraisor. President Saringer requested Chairman Lackey to take this issue into <br />the Recreation, Public Parks and Buildings Committee for discussion. Law Director <br />Gareau advised that there is indeed a restrictive covenant with a reversionary <br />right on this real estate and if the property is not used for recreational purposes, <br />it then reverts back to the original grantors. The original grantors were City <br />Line Subdivision; Mr. Joseph Lombardo and Mr. Carl Andreano were two of the people <br />involved. <br />Mr. Lackey asked for some further clarif ication with respect to the Mayor's Court <br />and some additional discussion. ensued.. <br />Law Director Gareau reported: 1) Received notification from the Sixth Circuit <br />Court of Appeals that the briefing schedule has been accelerated in the Cooper <br />Case; brief and assignments of error are to be presented the first week in <br />January. Within thirty days thereafter, the appellee, Cooper, has thirty days, <br />and a joint appendix will be due in March. Would expect to have oral argument <br />in this case, in Cincinnati, sometime in April or May. <br />2) Assistant Law Director, Jim Dubelko, appeared in Rocky Riven Municipah Court, <br />with Service Director Noble, on a default hearing Frith respect to damages to <br />city-owned property on Barton Road. <br />3) In the past week, has met with Squire, Sanders and Dempsey to work out final <br />details of a sewer agreement with the county. <br />4) Has been advised of a new case .dealing with a defective sider~a~,k qn M.apTe Ridge <br />Road and is in the process of sending it .through .the city anal in uratice company, <br />5) Attended a final pre-trial, dealing with damage to one a~ the city-oGtned buses, <br />and the case was settled for $500; approximately $600 damages-were Bane to the bus. <br />Finance Director Boyle reported: 1) Resaluti.on.No. 87-1,22, establish.ingthe tax <br />rates, and Ordinance No. 87-128., directing .the monies to be laid to .the City of <br />North Olmsted, are on the agenda this .evening. While Resoluti.on.No. 87-1,22 normally <br />shows rates and dollar amounts, they are not shown at this time, however pirector <br />Boyle reports that the figures passed by council in the budget is about what will <br />be received - $2,400,000 for the General Fund. <br />~~ <br />
