<br />Council Minutes of 9/1/87 <br />-2- <br />9) Law Director and Mayor attended a meeting today with the Mayors and. Managers <br />~'" Association and the County Commissioners. Last week, a vote had been taken to <br />the effect that the Mayors and Managers would retain their three votes and re- <br />questing that three votes be given from the County Commissioners; this would <br />then give six votes to the Mayors and Managers, with Cleveland having the other <br />four votes. A legal opinion was received today stating that the commissioners <br />could not give up their three votes, even if they wanted to. Mayors and Mana- <br />gers will meet next week to reconsider their position. <br />10) Ronald E. Cox was sworn in yesterday as a new member of the Police Depart- <br />ment; police officer.Barry O'Toole has passed the Sergeant's test with one of <br />the highest scores ever given in this area. <br />Law Director Gareau reported: 1) Law Department has submitted a brief in <br />opposition to jurisdiction in the Burger King Case as well as a reply brief <br />in the Romp Case. <br />2) A pre-trial was held on Nightfall; were not able to resolve any of the <br />differences; will have to go to trial. <br />3) Believes an agreement has been reached in the fire negotiations; legislation <br />will be presented to council within the next week. <br />Finance Director Boyle reported: 1) Due to the delayed start of tonight's <br />meeting, and since he gave a report to council at last night's Finance Committee <br />Meeting, he will leave all discussion to Chairman Wilamosky. <br />Mr. Wilamosky, Chairman Finance Committee reported: 1) Finance Committee met on <br />August 31st with all membexs in attendance as well as Mayor Petrigac, Finance <br />Director Boyle and Councilman Lackey. Committee discussed Ordinance No. 87-82 <br />which provides for the levying of a $5.00 per motor vehicle fee as provided for <br />under recent action by the state legislature. There are approximately 28,700 <br />licensed vehicles in North Olmsted which would generate approximately $143,000 <br />annually. Under the statute, the money must be used for roadway improvements, <br />maintenance, etc. but would not have to be earmarked for a State Highway Fund. <br />It therefore could be, and would be, used for improving roadways outside of <br />state highways - not limited to state .highways. The state has also authorized <br />the County to enact a similar tax. The County has not acted as yet but should <br />they enact that $5.00 tax, they would share a portion of it with North Olmsted. <br />Committee recommends adoption of Ordinance No. 87-82 with the understanding <br />that the revenues generated would be placed within the Street Maintenance Fund <br />and used for street improvements. <br />In the absence of Mr. O'Grady, Mr. Lackey. gave the following. Safety Committee <br />report: 1) Safety Committee met on July 28th with Mayor Petrigac, Chief Marsh, <br />Chief Van Kuren, Assistant Law Director Dubelko and Safety Director Becker in <br />attendance as well as Councilmen O'Grady, McKay and Lackey. Committee discussed <br />Ordinance No. 87-73 concerning the unlawful exposure by waiters, waitresses <br />and entertainers; asked for further information from the prosecutor. The ordin- <br />ance has been removed from tonight's agenda awaiting this information. <br />2) Also discussed was Ordinance No. 87-76, which committee recommends for adoption. <br />Chief Van Kuren stated that there are no provisions now to provide for access of <br />Fire Department vehicles into commercial, industrial and multi-family developments. <br />Ordinance No. 87-73 will provide for such access. <br />3) Mr. Lackey moved Council have no objection to the transfer of a D2, D2X and <br />D6 liquor permit from Great Northern Wines, Incorporated, dba Fine Wines of <br />Great Northern, 5245 Great Northern Mall, to the Corporate Food Services, In- <br />corporated, dba Corporate Cafe, Suite 198, 1st Floor, 25000 Country Club Boule- <br />vard, second by Mr. Bohlmann, unanimously approved. <br /> <br />
