Council Minutes of 7/21/87 <br />-5- <br />LEGISLATION (cont'd): <br />Resolution No. 87-71 introduced by Mr. Tallon was given its second reading. A <br />resolution accepting for recording purposes only the Bradley Oak Estates Sub- <br />division Plat in the City of North Olmsted. <br />Ordinance No. 87-72 introduced by Mayor Petrigac was given its. second reading. <br />An ordinance establishing a new Chapter 1503 in the Tax Code of the Codified <br />Ordinances of the City of North Olmsted entitled, "Lottery Tax". Mr. Wilamosky <br />moved for suspension of rule requiring three readings, second by Mr. O'Grady. <br />Mr. Rademaker objected to the motion for suspension of rule requiring three <br />readings because there was no time limitation on passage of this ordinance and <br />the normal three readings would provide a sufficient public forum to air the <br />legislation and finally address it. Roll call on motion for suspension of rule <br />requiring three readings on Ordinance No. 87-72: Affirmative vote: Bohlmann, <br />Lackey, McKay, O'Grady, Wilamosky, Negative vote: Rademaker. 5 Aye - 1 Nay - <br />Motion carried. Mr. Wilamosky moved for adoption, second by Mr. O'Grady. <br />Negative vote: Bohlmann, Lackey, McKay, O'Grady, Rademaker, Wilamosky. 0 Aye - <br />6 Nay - Motion unanimously defeated. Ordinance No. 87-72 not adopted. <br />Ordinance No. 87-73 introduced by Mayor Petrigac was given its second reading. <br />An ordinance amending Chapter. 533 of the Codified Ordinances entitled "Obscenity <br />and Sex Offenses" by adding thereto a new Section 533.15 entitled "Unlawful Ex- <br />posure by Waiters and Waitresses and Entertainers". <br />Ordinance No. 87-75 introduced by Mayor Petrigac was given its second reading. <br />An ordinance providing for the submission to the electors of the City of North <br />Olmsted of a proposed amendment to the Charter of the City of North Olmsted <br />permittinf~ the Mavor to serve. on a part-time basis on any Ohio State, County <br />or Regional Board or Commission, and declaring an emergency. <br />Ordinance No. 87-76 introduced by Mr. Tallon was given its second reading. <br />An ordinance creating new Section 1213.06 of the Zoning Code and new Chapter <br />1721 of the Fire Prevention Code providing design and construction standards <br />for Fire Department vehicle access upon commercial, industrial and multi- <br />family properties located within the City of North Olmsted, and declaring an <br />emergency. <br />Ordinance No. 87-77 introduced by Mayor Petrigac was given its first reading. <br />An ordinance authorizing the Mayor to enter into an agreement with Ohio Bell <br />Communications to provide and install all of the positron E911 :equipment re- <br />quired to participate in the County-wide 911 Program, and declaring an emergency. <br />Mr. Wilamosky moved for suspension of rule requiring three readings as well as <br />referral to committee, second by Mr. McKay, unanimously approved. Mr. Wilamosky <br />moved for adoption, second by Mr. Bohlmann, unanimously approved. Ordinance No. <br />87-77 adopted. <br />Miscellaneous business: <br />Mr. Wilamosky scheduled a Finance Committee Meeting for .Thursday, July 23rd, <br />at 8 P.M., with Finance Director Boyle, RITA representative, Director Cunningham, <br />Mayor Petrigac and any interested council member to also be in attendance. <br />Mr. Wilamosky scheduled a Risk Management Committee Meeting for Monday, July 27th, <br />at 8 P.M. and requested the Clerk to notify committee members of the meeting. <br />Mr. Wilamosky also commented that effective July 24, 1987, various sections of the <br />Ohio Revised Code have been changed which would allow a local municipality to renew <br />or object to the renewal of a liquor permit based on a number of factors that were <br />never before permitted within the state statute. Requested the Mayor to confer <br />with the Safety Department to determine the status of a number of permit holders <br />
