Council Minutes of 4/7/57 _3_ <br />2) Mr. McDermott presented the Pebblebrook Subdivision realignment; the re- <br />alignment of two properties. This is covered by legislation, Resolution No. 87-30, <br />on first reading tonight. Mr. Tallon moved Council approve the Pebblebrook Sub- <br />division realignment, second by Mr. Rademaker, unanimously approved. <br />3) Committee discussed Ordinance No. 86-92, the ten-foot setback ordinance. It <br />was the committee's decision to retain in committee for presentation to the City <br />Planner when one is hired. Committee feels the ordinance would create a problem <br />within the Zoning Code. City presently has a f ifty foot setback stipulation with <br />a seven foot green area; eighteen foot driveWa.ys; twenty foot parking spaces and <br />approximately five foot sidewalk stipulations. Adding these areas together re- <br />sults in a total of fifty feet. If the green area were increased to ten feet from <br />its present seven feet, all the proposals that had the fifty foot setback would <br />have to go to the Board of Zoning Appeals to be varianced on the extra three feet. <br />Committee feels this would create a stumbling block and if the BZA did not grant <br />the variances, the city could face lawsuits. Committee will therefore retain <br />this legislation and perhaps incorporate it in a total plan for setbacks. If this <br />cannot be done, committee will bring it to the council table and recommend that <br />it be defeated or tabled. <br />Mr. O'Grady, Chairman Public Health, Safety and Welfare Committee reported: <br />1) Moved Council have no objection to the issuance of an F2 liquor permit for the <br />North Olmsted Chamber of Commerce, North Olmsted Party Center, 29271 Lorain Road, <br />for a function to be held on April 23rd, second by Mr. Lackey, unanimously approved. <br />2) Moved Council have no objection to the issuance of an F2 liquor permit for the <br />St. Clarence Mens' Club, 30106 Lorain Road, for a function to be held on Saturday, <br />April 25th, second by Mr. Lackey, unanimously approved. <br />3) Moved Council have no objection to the transfer of a Cl, C2 and D6 liquor permit <br />from the North Olmsted Beverage Incorporated, 30791 Lorain Road to the North Olmsted <br />Beverage Incorporated, dba North Olmsted Drive Thru Beverage and Video Store, 30781 <br />Lorain Road, second by Mr. Lackey, unanimously approved. <br />Mr. Lackey, Chairman Recreation Public Parks and Buildings Committee reported: <br />1) As a member of the Intro-Governmental Relations and Legislation Committee, <br />would like. to report that a meeting was held on Wednesday, March 25th, to discuss <br />cable television rate increases.; committee also listened to the concerns expressed <br />by the residents in attendance. Very briefly, the possibility of increasing the <br />franchise fee from.3~ to 57 was discussed but no action was taken. <br />2) The Cable TV Advisory Board also. met this same evening with the General Manager <br />for Cablevision, Mr. A11en Ext. Several issues were discussed: the additional <br />services the new franchise has brought. to the city, such as Bravo, Discovery, <br />C-Span, etc.; future plans for pay previewing. Tree trimming and servicing and <br />maintaining the cable lines was also mentioned. While the contract includes this, <br />there has been no problem as yet. The proposed Cablevision rate increase was not <br />discussed at the formal meeting, however, at the close of the meeting, Mr. Ext <br />did stay and discuss the rate increase with the attending residents and gave some <br />justification for the increases. Mr. Lackey and other members are greatly dis- <br />appointed in the proposed increases since Cablevision had said when they first <br />proposed to buy out West Shore that they WOULD NOT increase rates and WOULD pro- <br />vide as good, if not better, service.
