Requested the <br />Mayor to preview the show and not permit such things to be presented in North <br />Olmsted. Law Director Gareau stated that the Mayor is not the chief conserva- <br />tor of the peace relative to enforcement of the city's pornography ordinances. <br />Mrs. McKay's complaints should be directed to the appropriate authority, namely, <br />the Police Department and the City Prosecutor; they will determine whether or <br />not there is a violation of local ordinances. This country has freedom of ex- <br />pression and freedom of speech so something cannot be outlawed before it is <br />even presented. <br />Mr. Mark Godfrey, Vice President Timber Trails Association, again discussed the <br />numerous violations of the city's Zoning Code by Nightfall nightclub. The <br />abutting residents want the integrity of their neighborhood restored; erection <br />of a barrier fence along the residential property; paving of the back area if it <br />is going to be used for parking vehicles; adjusting the lights to point towards <br />the nightclub and not toward hames;.lowering the volume of the music. Law <br />Director Gareau stated that he was very distressed that this issue was withdrawn <br />from the Planning Commission agenda last week where it could have been aired <br />publicly. Mr. Gareau advised that if he did not receive a report by the end of <br />the week, as to whether or not there would be compliance with the city Zoning <br />Codes, or whether an application would be filed before the Planning Commission <br />next week, then he will file a lawsuit to restrict and restrain the owner from <br />continuting to utilize the property. <br />Mr. Logan noted that there seemed to be a number of issues with respect to the <br />Building Department lately; does not feel that Safety Director Becker can <br />respond to council's questions as readily as Building Coa¢nissioner Spino; <br />therefore, Mr. Logan moved that Building Commissioner be in attendance at future <br />Council Meetings, second by Mr. Wilamosky, unanimously approved. <br />LEGISLATION: <br />Resolution No. 86-1 introduced by Mr. McKay was given its third reading. A <br />resolution authorizing the Director of Finance to advertise for bids for a copy <br />machine for use in the Finance Department, and declaring an emergency. Mr. McKay <br />moved to table Resolution No. 86-1 due to the financial condition of the city, <br />second by Mr. O'Grady, unanimously approved. Resolution No. 86-1 TABLED. <br />Ordinance No. 86-126 introduced by Mr. Wilamosky was given its third reading. <br />An ordinance establishing the compensation to be paid to all hourly employees <br />employed by the North Olmsted Municipal Bus Line, and declaring an emergency. <br />Mr. Wilamosky moved for adoption, second by Mr. Tallon, unanimously approved. <br />Ordinance No. 86-12b adopted. <br />i <br />
