1 <br />t Council Minutes of 1/6/87 <br />-3 - <br />Law Director Gareau stated that council should probably meet and discuss the <br />~''~"` realistic aspects of the development of Brookpark Road.. Some day, somebody <br />''°"~ is going to want to develop the property there. President Saringer invited <br />Mr. Koulis to attend the BZD Committee Meeting when this subject is discussed; <br />Chairman Tallon will notify him. <br />Mr. Jack Schuler, 24640 Clareshire, President of Coldbrook Condo Association, <br />stated that his association is .also against the curb cut requested by Great <br />Northern Development Corporation. <br />Mr. Mark Godfrey, Vice-President Timber Trails Association, addressed council <br />with respect to many code violations at the Nightfall nightclub. Would like <br />the zoning code to be enforced. Plans on being in attendance at the next <br />Planning Commission meeting on January 13th; can the Planning Commission inter- <br />pret the law and judge compliance after the facility has been allowed to open? <br />Law Director Gareau pointed out that the building existed and was used as a <br />lounge before Timber Trails was developed; it became a party center and now is a <br />nighclub - all a similar use and consistent in a General Retail Business District. <br />If the use has not changed, it does not come back before Planning Commission. <br />If they expand the building, ask for more parking, request a curb cut, etc., then <br />it comes before the Planning Commission. Mr. Godfrey stated that the residents <br />feel the use has drastically changed; Mr. Gareau stated the zoning code does not <br />make a differentiation. Mr. Gareau also agreed that if the owner is utilizing <br />a gravelled area as off icial parking spaces, it must be blacktopped. He also <br />pointed out that the city does have an enforceable noise ordinance. Hopefully, <br />at the January 13th meeting, some cooperation by the owner will provide the <br />residents with some relief. <br />LEGISLATION: <br />Ordinance No. 86-124 introduced by Mr. O'Grady was given its third reading. An <br />ordinance amending the Traffic Control File of the City to provide for the <br />elimination of the traffic signal at the intersection of Butternut Ridge Road <br />and Old Columbia Road and further, to provide for the installation of a "stop" <br />sign on the. southwest corner of Butternut Ridge and Columbia Road to control <br />traffic travelling in an easterly direction on Butternut Ridge Road, and de- <br />claring an emergency. Mr. O`Grady moved for adoption, second by Mr. Wilamosky, <br />unanimously approved. Ordinance No. 86-124 adopted. <br />Ordinance No. 86-125 introduced by Mayor Petrigac was given its third reading. <br />An ordinance authorizing the Mayor, on behalf of the City, to extend the existing <br />agreement with BFI for a one (1) year period for refuse pickup within the City, <br />and declaring an emergency. Mr. Wilamosky moved for adoption, second by Mr. <br />McKay, unanimously approved. Ordinance No. 86-125 adopted. <br />Ordinance No. 86-126 introduced by Mr. Wilamosky was given its second reading. <br />An ordinance establishing the compensation to be paid to all hourly employees <br />employed by the North Olmsted Municipal Bus Line, and declaring an emergency. <br />Ordinance No. 86-127 introduced by Mr. Wilamosky was given its second reading. <br />An ordinance establishing the compensation to be paid to administrative and. <br />supervisory personnel employed by the North Olmsted Municipal Bus Line, and <br />declaring an emergency. <br />Resolution No. 86-128 introduced by Mayor Petrigac was given its second reading. <br />A resolution adopting the North Olmsted Transportation Study Community Trans- <br />portation Plan prepared by the North Olmsted Transportation Study Team. <br /> <br />
