i <br />Council Minutes of 11/15/88 <br />-3- <br />Mrs. Bahas asked for clarification on the Mayor's report that a committee would <br />be formed to "monitor" the development of the Crocker Road Extension; shouldn't <br />the term "in-put" be used rather than "monitor". Mayor agreed that was a <br />better choice of words. Mrs. Bahas stated that her committee would welcome in- <br />put from a well-rounded representative group which would include those people <br />on Mrs. Brookshre's list as well as others. <br />Law Director Gateau reported: 1) The contempt hearing .with respect to the Night- <br />fall Case was heard; the owner was held in contempt and was incarcerated; within <br />twelve hours a permanent barricade was placed across the parking lot to prohibit. <br />individuals from traversing to the back portion of the lot. The appellate hearing, <br />before the Court of Appeals, was also held. If the attorney for the owner of <br />Nightfall had filed the motion to stay, the contempt hearing would not have been <br />held. <br />2) As reported in the newspapers, the Rocky River Case dealing with the fire- <br />fighters was heard by the Supreme Court. Law Director reviewed that opinion and <br />it basically provides that the portion of Ohio law which required binding arbi- <br />tration in cases of safety forces was unconstitutional. During our last negotia- <br />tions with both the fire and police, it went to fact finding and then became <br />binding on the City. of North Olmsted. This is something the administration can <br />look at in the future; currently, negotiations are taking place with the North <br />Olmsted Police Department. <br />3) In the last week, had an opportunity to talk to Felix Spitzler at the County <br />Engineer's office; is assembling certain paper work and working with Mr. Spitzler <br />to implement the vote that took place last Tuesday. <br />4) Has had a long, hard battle with respect to the RTA agreement; fought the case <br />through every court system in the United States - all the way to the United States <br />Supreme Court in order to save the North Olmsted Bus Line, Would urge council to <br />set up a period of time to fully discuss Ordinance No. 88-128, which covers the <br />operating agreement, with Law Director, Tom Terbrack and/or Ken Mues, to explain <br />all the ingredients that went into this contract. Law Director is satisfied with <br />it and recommends that it be passed. <br />5) With respect to the Columbia Road high accident problem, thinks it only fair <br />to advise council that Ron Tallon has requested the Law Director to prepare an <br />ordinance dealing with the reestablishment of the center line so that it would fall <br />completely within the City of North Olmsted. Has had some trouble with the <br />verbiage - conceptually, it is very difficult to put into language. Hopes to have <br />legislation ready for the next council meeting on December 6th. <br />President Saringer announced that she would schedule a Council-as-a Whole Committee <br />Meeting to discuss Ordinance No. 88-128, the RTA contract, as suggested by Law <br />Director Gateau. <br />Finance Director Boyle reported: 1) Based on the old RTA contract, bus drivers <br />are allowed higher hospitalization coverage than the remainder of city employees; <br />they receive dental and optical care but pay for the difference. Their contract <br />came up in August and in negotiations a proposal was made by Regional Transit to <br />the union for an increase in hospitalization coverage. Since the contract ex- <br />pired in August, the city has been withholding from the employees' pay, an amount <br />equal to what it would have been under the old contract. Since the hospitalization <br />will increase under the new contract, those employees are going to get a refund. <br />Bus Department will refigure all refunds and Finance Department will be cutting <br />these checks the week of the 28th. Anew ordinance will be introduced by the <br />Mayor at the December 6th meeting, covering their admin people, based on the old <br />contract. Would ask council to pass this ordinance at the December 6th meeting <br />since retroactive pay will be involved and Finance Director would like the <br />checks out before the end of 1988. <br />,. <br />L <br />
