"~ ~ r .. <br />s <br />i <br />. _ '~. <br /> <br />MINUTES OF PUBLIC HEARING <br />NOVEMBER 15, 1988 <br />7:00 P.M. <br />Present: President Janet Saringer, Councilwoman Bahas, Councilmen <br />Boehmer, Bohlmann, McKay, O'Grady, Tallon, Wilamosky. <br />Also present: Law Director Michael Gareau, Clerk of Council Florence Campbell. <br />Public Hearing was called to order by President Saringer at 7:10 P.M. <br />President Saringer announced that this Public Hearing would cover Ordinance <br />No. 88-112, an ordinance amending Section 1135.02 of the Zoning Code en- <br />titled "Accessory Uses and Buildings" of Chapter 1135 of the Zoning Code en- <br />titled "Residence Districts" as well as Ordinance No. 88-118, an ordinance <br />providing for the amendment of the Zone Map of the City of North Olmsted, <br />which Zone Map is part of the Zoning Code of the City of North Olmsted by <br />changing the premises hereinafter described from Single Residence C District <br />to Office Building District and further, from certain premises hereinafter <br />described, from Multiple Residence District to Office Building District. <br />President Saringer asked if anyone in the audience would like to address <br />Ordinance No. 88-112. <br />Audience participation: <br />Mr. Chester H. Remmel, 23354 5toneybrook Drive, Chairman of the Zoning Board <br />of Appeals, stated his objections to Ordinance No. 88-112, which would allow <br />six foot fences to be erected. BZA has generally granted six foot fence variances <br />where they are deserved but is opposed to establishing a standard of six feet for <br />all fencing. Feels this ordinance should be reviewed by the Planning Review <br />Committee and City Planner, Robert Hill; also, is amazed that this ordinance was <br />not presented to the Zoning Board of Appeals whose expertise would have been of <br />value in considering such a change. <br />Mr. Tallon advised that Ordinance No. 88-112 will not be on third reading this <br />evening; he will ask that it be removed from the council agenda and it will be <br />discussed at the Building, Zoning and Development Committee Meeting to be held <br />on December 1st. Members of the Zoning Board of Appeals, the Planning Commission <br />and concerned citizens will be able to address the BZD Committee at that time <br />and voice their opinions. <br />Mr. McKay stated that he introduced Ordinance No. 88-112 because of many complaints <br />with respect to the five foot height limitation; as the-city becomes more popu- <br />lated there is a need for privacy. Also, the city already has a requirment for <br />six foot fencing for a swimming. pool and there does not seem to be a problem with <br />that. <br />Mr. Ronald Bugala, 26678 Leenders Lane, Member of the Board of Zoning Appeals, <br />stated that he is very thankful that North Olmsted does not have many fences; <br />he has seen the height raised from four to five feet and if a six foot height is <br />approved, where will it end; truthfully, does not see any difference between a <br />five foot fence and a six foot fence. <br /> <br />
