Council Minutes of 6/7/88 <br />The Planning Commission is very concerned about the silence and secrecy re- <br />gardng this whole issue. Law Director Gareau advised that the courts have <br />recently done a flip-flop with respect to zoning issues. It used to be that <br />cities were pretty much backed up by the court; this is no longer true. The <br />courts are now coming back with judgments against cities that have failed to <br />take appropriate action. The City of North Olmsted is currently looking at <br />alternatives; Planning Commission will not be cut out of any discussions <br />when the situation has jelled. They will definitely be a part of what is <br />hoped to be something the city can live with and a plan that the Planning <br />Commission can live with. Is not ready to indicate what this is yet because <br />the city does not really know at this time. Once a decision has been reached, <br />it will be brought to the Planning Commission and be considered in open forum. <br />With respect to the fact that Mr. Moran and Mr'. Gorris' names appear on the <br />suit, Law Director Gareau moved to dismiss when their names were put on and <br />it was granted because it wasn't proper. <br />Glen Vannoy, 4811 Clague Road, discussed the two ordinances with respect to <br />traffic on Clague Road; thanked Mr. O'Grady for keeping them in committee; <br />agreed that the traffic problems on Clague Road have improved considerably <br />with the retiming of the traffic lights. Mr. Vannoy gave a detailed ex- <br />planation of how vehicles can more expeditiously access 1480. <br />Gemma Szabo, 30837 Bradley Road, discussed the recent water ban and asked if <br />this ban could be rigidly enforced since the pressure in her water line is <br />too low to allow the toilet to be flushed. Is the ban in effect for the entire <br />city? Mayor Petrigac responded that the ban was indeed in force throughout the <br />entire city and was being enforced by the police force. Even some of the car- <br />wash establishments have voluntarily closad down. Fire Chief Van Koren has <br />reported that he feels there is sufficient water in the pumpers and by using <br />equipment to bring up pressure at the hydrants to take care of any emergency. <br />LEGISLATION: <br />Ordinance No. 88-59 introduced by Mr. Wilamosky was given its second reading. <br />An ordinance providing for the issuance and sale of $90,000 notes, in antici- <br />pation of the issuance of bonds, to pay costs of improving Lorain Road (State <br />Route 10) between certain termini in cooperation with the Director of Trans- <br />portation of the State of Ohio, by resurfacing with asphaltic concrete and re- <br />constructing the pavement base, curbs and sidewalks, where necessary, together <br />with all necessary appurtenances thereto.., and declaring an emergency. Mr. <br />Wilamosky moved to table Ordinance No. 88-59, second by Mr. Tallon, unanimously <br />approved. Ordinance No. 88-59 tabled. <br />-5- <br />Ordinance No. 88-60 introduced by Mayor Petrigac and the entire Council was <br />given its second reading. An ordinance to amend Sections 1101.02, 1101.03, <br />1101.04, 1101.05, 1101.06 and 1101.10 of the Codified Ordinances of the City of <br />North Olmsted, Ohio., and to enact Section 1101.11 to those Codified Ordinances, <br />all to provide that, in lieu of installing all improvements or posting performance <br />and maintenance bonds required in connection with the acceptance of a final plat, <br />a developer may petition council for the construction of such improvements and <br />the levying of special assessments to pay the costs thereof, and to declare an <br />emergency, as amended. Mr. Tallon moved to suspend the rules requiring three <br />readings as well as committee report, second by Mr. O'Grady, unanimously approved. <br />• Mr. Tallon moved for ado-pton, second by Mr. O'Grady, unanimously approved. <br />Ordinance No. 88-60 adopted. <br />
